Section 81
SEC. 81. Kaingin. — Any person or association of persons who violates the provisions of Section 35 of this Code, or the regulations promulgated thereunder, or encourages, abets or knowingly permits, through negligence, inaction or positive action, encroachment or unauthorized occupancy of the public forests shall, upon conviction, be imprisoned for a period of not less than one (1) year, without prejudice to the payment of the full cost of restoration of the occupied area as determined by the Bureau. The offender shall thereafter be evicted from the premises and all improvements thereon shall be confiscated and forfeited in favor of the Government. In case the offender is a government official or employee, he shall, in addition to the above penalties, be deemed automatically dismissed from office and permanently disqualified from holding any elective or appointive position.
