§ 12 — What is an authorial work with an identified author
12.—(1) An authorial work has an identified author if —(a)
the identity of the author is generally known or can reasonably be ascertained; or
(b)
in the case of a work of joint authorship — the identity of at least one of the authors is generally known or can reasonably be ascertained.
(2) For the purposes of subsection (1) —(a)
the identity of the author of an authorial work is deemed to be generally known if —(i)
the work is published; and
(ii)
the true name of the author, or a name by which the author is generally known, is specified in the published work as the author; and
(b)
the identity of an author is not generally known just because the pseudonym of the author is generally known.
—(1) An authorial work has an identified author if —(a)

(2) For the purposes of subsection (1) —(a)
the identity of the author of an authorial work is deemed to be generally known if —(i)

(ii)
the true name of the author, or a name by which the author is generally known, is specified in the published work as the author; and
(b)
the identity of an author is not generally known just because the pseudonym of the author is generally known.
