§ 121 — Nature of copyright in sound recordings
121. For the purposes of this Act, unless the contrary intention appears, copyright in a sound recording is —(a)
the exclusive right to do all or any of the following acts:(i)
to make a copy of the recording;
(ii)
to enter into a commercial rental arrangement in respect of the recording;
(iii)
to publish the recording if it is unpublished;
(iv)
to communicate the recording to the public; and
(b)
if the recording has been published for commercial purposes and a person (X) causes the sounds embodied in the recording to be heard in public, the right to be paid equitable remuneration of an amount —(i)
agreed between the copyright owner and X; or
(ii)
in default of agreement, decided by a Copyright Tribunal.
