Section 38 — What is a recording of a protected performance

(1)A “recording”, in relation to a protected performance, means a sound recording of the performance or a substantial part of the performance, and includes a copy of such a recording.

(2)To avoid doubt, Subdivision (6) applies to recordings of protected performances as it applies to other sound recordings.
