Administration of Act

s 4

4.—(1) The Director‑General is responsible for the administration and enforcement of this Act, subject to the general and special directions of the Minister.[Act 11 of 2023 wef 01/05/2023] (2) The Director‑General may in writing appoint any public officer or any officer of any statutory body to be an authorised officer for the purposes of this Act.[Act 11 of 2023 wef 01/05/2023] (3) Every authorised officer, when exercising his or her powers and carrying out his or her duties under this Act, must comply with such general or special directions as may, from time to time, be given to the authorised officer by the Director‑General.[Act 11 of 2023 wef 01/05/2023] (4) Every authorised officer when exercising any of his or her powers under this Act must, if not in uniform, declare his or her office and must, on demand, produce to any person affected by the exercise of that power such identification card as the Director‑General may direct to be carried by the authorised officer when exercising such power.[Act 11 of 2023 wef 01/05/2023] (5) The Director‑General may, in writing, delegate all or any of the powers conferred on the Director‑General by this Act to any authorised officer subject to such conditions or restrictions as the Director‑General thinks fit, except the power of delegation conferred by this subsection.[Act 11 of 2023 wef 01/05/2023] (6) The Director‑General may, in writing, authorise any other person to assist the Director‑General or an authorised officer in the administration and enforcement of this Act.[Act 11 of 2023 wef 01/05/2023] (7) Every authorised officer and every person authorised under subsection (6) is deemed to be a public servant for the purposes of the Penal Code 1871.

Advisory committees

5.—(1) The Minister may establish one or more advisory committees consisting of such persons as the Minister thinks fit to appoint for the purpose of advising the Minister on any matter arising out of the administration of this Act. (2) The Director‑General may establish one or more advisory committees consisting of such persons as the Director‑General thinks fit to appoint for the purpose of advising the Director‑General on any matter arising out of the administration, functions and enforcement of this Act.[Act 11 of 2023 wef 01/05/2023]
