(1) This Order may be cited as the Consular Fees Act 1980 (Fees) Order 2000 and shall come into force on the day after it is made.
(2) In this Order “the Finance Act” means the Finance (No. 2) Act 1987.
(3) In this Order “the Fees Act” means the Consular Fees Act 1980.

The Consular Fees Act 1980 (Fees) Order 2000 (S.I. 2000/3353)
This Order specifies functions and matters which are to be taken into account in the determination of fees fixed by Her Majesty by Order in Council under section 1 of the Consular Fees Act 1980.

(1) In relation to the functions mentioned in sub-paragraph (2) below, the costs of which fall to be taken into account on the exercise of the power to fix the fees to which sub-paragraph (3) below applies, the following matter, namely, any deficit incurred before the exercise of the relevant power (including any incurred before the making of this Order), is hereby specified for the purposes of section 102(4) of the Finance Act as one which is to be taken into account in determining those costs.
(2) The said functions are consular functions, or functions in the United Kingdom corresponding to consular functions, as set out in section 1(1) and (2) of the Fees Act.
(3) This sub-paragraph applies to fees levied under section 1 of the Fees Act.
(1) In relation to the power to fix the fees to which sub-paragraph (3) below applies, the costs of the functions mentioned in sub-paragraph (2) are hereby specified for the purposes of section 102(3) of the Finance Act as ones which are to be taken into account in determining the amount of those fees.
(2) The said functions are the issuing of passports to applicants under 16 years by persons authorised by the Secretary of State to exercise consular functions, or functions in the United Kingdom corresponding to consular functions, as set out in section 1(1) and (2) of the Fees Act.
(3) This sub-paragraph applies to fees levied under section 1 of the Fees Act for the issue of passports to applicants aged 16 or over.
