The Hywel Dda National Health Service Trust (Establishment) Order 2008 (S.I. 2008/712 (W.))

This Order establishes the Hywel Dda National Health Service Trust, an NHS trust provided for in section 18 of the National Health Service (Wales) Act 2006. It also provides for the functions of the trust (article 3) and the number of executive and non-executive directors (article 4). art 1Title, commencement and interpretationOpen β†—
(1) The title of this Order is the Hywel Dda National Health Service Trust (Establishment) Order 2008 and it comes into force on 12 March 2008. (2) In this Order unless the context otherwise requires β€” β€œthe Act” (β€œ y Ddeddf ”) means the National Health Service (Wales) Act 2006; β€œcommunity health services” (β€œ gwasanaethau iechyd cymunedol ”) means any service which the Welsh Ministers may provide under section 3(1) of or Schedule 1 to the Act; β€œestablishment date” (β€œ dyddiad sefydlu ”) means 12 March 2008; β€œoperational date” (β€œ dyddiad gweithredol ”) has the meaning assigned to it in paragraph 5(5) of Schedule 3 to the Act; β€œthe trust” (β€œ yr ymddiriedolaeth ”) means the Hywel Dda National Health Service Trust established by article 2 of this Order.
art 2Establishment of the trustOpen β†—
There is hereby established a National Health Service trust which is called the Hywel Dda National Health Service Trust or Ymddiriedolaeth Gwasanaeth Iechyd Gwladol Hywel Dda.
art 3Nature and functions of the trustOpen β†—
(1) The trust is established for the purposes specified in section 18(1) of the Act. (2) The trust’s functions are to provide goods and services (including hospital accommodation and community health services) from β€” (a) Bronglais General Hospital, Caradoc Road, Aberystwyth, SY23 1ER, (b) Prince Philip Hospital, Bryngwynmawr, Dafen, Llanelli, SA14 8QF, (c) West Wales General Hospital, Dolgwili Road, Carmarthen, SA31 2AF, (d) Withybush General Hospital, Fishguard Road, Haverfordwest, SA61 2PZ and associated hospitals and premises.
art 4Directors of the TrustOpen β†—
(1) The trust will have, in addition to the chairman, 7 non-executive directors and 5 executive directors. (2) Since the trust is to be regarded as having a significant teaching commitment within the meaning of paragraph 5(3) of Schedule 3 to the Act, one of the non-executive directors is to be appointed from Swansea University.
art 6Limited functions before operational dateOpen β†—
Between its establishment date and its operational date the trust has the functions β€” (a) of entering into NHS contracts; (b) of entering into other contracts including contracts of employment; and (c) of doing such other things as are reasonably necessary to enable it to begin to operate satisfactorily with effect from its operational date.
