(1) The title of this Order is the Cwm Taf National Health Service Trust (Establishment) Order 2008 and it comes into force on 12 March 2008.
(2) In this Order unless the context otherwise requires β
βthe Actβ (β y Ddeddf β) means the National Health Service (Wales) Act 2006;
βcommunity health servicesβ (β gwasanaethau iechyd cymunedol β) means any service which the Welsh Ministers may provide under section 3(1) of or Schedule 1 to the Act;
βestablishment dateβ (β dyddiad sefydlu β) means 12 March 2008;
βoperational dateβ has the meaning assigned to it in paragraph 5(5) of Schedule 3 to the Act;
βthe trustβ (β yr ymddiriedolaeth β) means the Cwm Taf National Health Service Trust established by article 2 of this Order.

This Order establishes the Cwm Taf National Health Service Trust, an NHS trust provided for in section 18 of the National Health Service (Wales) Act 2006. It also provides for the functions of the trust in article 3. It specifies the operational date and accounting date of the trust in article 5.

There is hereby established a National Health Service trust which is called the Cwm Taf National Health Service Trust or Ymddiriedolaeth Gwasanaeth Iechyd Gwladol Cwm Taf.
(1) The trust is established for the purposes specified in section 18(1) of the Act.
(2) The trustβs functions shall be to provide goods and services (including hospital accommodation and community health services) from
(a) Royal Glamorgan Hospital, Ynysmaerdy, Llantrisant, CF72 8XR;
(b) Prince Charles Hospital, Merthyr Tydfil, CF47 9DT;
and associated hospital and premises pursuant to section 18(1) of the Act.
(1) The trust shall have, in addition to the chairman, 7 non-executive directors and 5 executive directors.
(2) Since the trust is to be regarded as having a significant teaching commitment within the meaning of paragraph 5(3) of Schedule 3 to the Act, one of the non-executive directors is to be appointed from Cardiff University.
(1) The operational date of the trust shall be 1 April 2008.
(2) The accounting date of the trust shall be 31 March.
Between its establishment date and its operational date the trust has the functionsβ
(a) of entering into NHS contracts
(b) of entering into other contracts including contracts of employment; and
(c) of doing such other things as are reasonably necessary to enable it to begin to operate satisfactorily with effect from its operational date.
