s 40 Continuance of criminal and civil proceedings
(1) Subject to the provisions of this Act, any proceedings, whether civil or criminal, or any cause of action pending or existing immediately before the appointed date by or against—
(a) MARA in respect of ITM;
(b) any person acting on behalf of MARA in respect of ITM;
(c) ITM; or
(d) any person acting on behalf of ITM,
may be continued or instituted by or against the Universiti established by this Act as it might have been by or against the same respectively as if this Act had not been passed.
(2) Any appeal brought or any leave to appeal applied for on or after the appointed date against a decision given in any legal proceedings before that date may be brought by or against the Universiti established by this Act.

Penerusan prosiding jenayah dan sivil
(1) Tertakluk pada peruntukan Akta ini, mana-mana prosiding, sama ada sivil atau jenayah, atau apa-apa kausa tindakan yang belum selesai atau yang sedia ada sebaik sebelum tarikh yang ditetapkan yang diambil oleh atau terhadap—
(a) MARA berkenaan dengan ITM;
(b) mana-mana orang yang bertindak bagi pihak MARA berkenaan dengan ITM;
(c) ITM; atau
(d) mana-mana orang yang bertindak bagi pihak ITM,
boleh diteruskan atau dimulakan oleh atau terhadap Universiti yang ditubuhkan oleh Akta ini sebagaimana ia mungkin diambil oleh atau terhadap masing-masing yang disebut di atas seolaholah Akta ini tidak diluluskan.
(2) Apa-apa rayuan yang dibuat atau mana-mana kebenaran untuk merayu yang dipohonkan pada atau selepas tarikh yang ditetapkan terhadap sesuatu keputusan yang diberikan dalam mana-mana prosiding undang-undang sebelum tarikh itu boleh dibuat oleh atau terhadap Universiti yang ditubuhkan oleh Akta ini.
