s 12 Use by proposed registered user to be considered for the purpose of determining distinctiveness, etc.

(1) Where an application for registration of a trade mark has been made by a person, and before the date of the application the trade mark had been used by a person other than the applicant under the control of and with the consent and authority of the applicant, and where an application is made by the applicant and that other person for the registration of that other person as a registered user of the trade mark immediately after the registration of the trade mark and the Registrar is satisfied that the other person is entitled to be registered as a registered user of the trade mark, the Registrar may, for the purpose of determining whether the trade mark is distinctive of or capable of distinguishing the goods or services of the applicant, treat use of the trade mark by that other person as equivalent to use of the trade mark by the applicant and may make an order that the trade mark is so distinctive or capable of distinguishing. (2) An order of the Registrar under subsection (1) is subject to appeal to the Court. (3) Where an order is made under subsection (1), the registration of the trade mark shall cease to have effect if at the expiration of the prescribed period, or such further period not exceeding six months as the Registrar may allow, that other person has not become registered as the registered user of the trade mark.

Penggunaan oleh pengguna berdaftar yang dicadangkan boleh ditimbang bagi maksud menentukan kedistinktifan, dsb.

(1) Jika sesuatu permohonan bagi pendaftaran cap dagangan telah dibuat oleh seseorang, dan sebelum tarikh permohonan itu cap dagangan itu telah digunakan oleh seseorang yang selain daripada pemohon itu di bawah kawalan dan dengan persetujuan dan kuasa pemohon, dan jika sesuatu permohonan dibuat oleh pemohon dan orang yang satu lagi itu bagi pendaftaran orang yang satu lagi itu sebagai pengguna berdaftar cap dagangan itu selepas sahaja pendaftaran cap dagangan itu dan Pendaftar berpuas hati bahawa orang yang satu lagi itu berhak didaftarkan sebagai pengguna berdaftar cap dagangan itu, Pendaftar boleh, bagi maksud menentukan sama ada cap dagangan itu adalah distinktif atau boleh membezakan barang-barang atau perkhidmatan pemohon, mengira penggunaan cap dagangan itu oleh orang yang satu lagi sebagai setara dengan penggunaan cap dagangan itu oleh pemohon dan boleh membuat perintah bahawa cap dagangan itu adalah distinktif atau boleh membezakan sedemikian. (2) Sesuatu perintah Pendaftar di bawah subseksyen (1) tertakluk kepada rayuan kepada Mahkamah. (3) Jika sesuatu perintah dibuat di bawah subseksyen (1), pendaftaran cap dagangan itu hendaklah terhenti berkuat kuasa jika apabila tamat tempoh yang ditetapkan, atau apa-apa tempoh lanjut yang tidak melebihi enam bulan yang dibenarkan oleh Pendaftar, orang yang satu lagi itu belum didaftarkan sebagai pengguna berdaftar cap dagangan itu.
