Subject to the provisions of this Act,— (a) the person for the time being entered in the Register as registered proprietor of a trade mark shall, subject to any rights appearing from such Register to be vested in any other person, have power to assign the same and give good discharges for any consideration for the assignment; (b) any equities in respect of a trade mark may be enforced in like manner as in respect of any other personal property.
Kuasa tuan punya berdaftar
Tertakluk kepada peruntukan Akta ini— (a) orang yang pada masa itu dicatatkan dalam Daftar sebagai tuan punya berdaftar sesuatu cap dagangan adalah berkuasa, tertakluk kepada apa-apa hak yang terdapat dalam Daftar sebagai diletak hak pada mana-mana orang lain, menyerahhakkan cap dagangan itu dan memberi penyelesaian yang sah bagi apa-apa balasan untuk penyerahhakan itu; (b) apa-apa ekuiti mengenai sesuatu cap dagangan boleh dikuatkuasakan sama seperti ekuiti mengenai apa-apa harta diri yang lain.
