s 5 Indemnity of public officers and certain other persons

No action, prosecution or other legal proceeding whatsoever shall be brought, instituted or maintained in any court against any public officer either personally or in his official capacity for or on account of or in respect of any act ordered or done by him or purporting to have been ordered or done by him during the emergency period for the purpose of maintaining order or public security or of carrying into effect any regulation, order, rule, by-law, direction or notice made or issued under this Act, and no suit, prosecution or other legal proceeding shall lie in any court against any other person for or on account of or in respect of any act done or purporting to have been done by him under any regulation, order, rule, by-law, direction, notice or instruction of any public officer given for any such purpose as aforesaid: Provided that the act of such officer or person was done in good faith and in a reasonable belief that it was necessary for the purpose intended to be served thereby.

Tiada apa jua tindakan, pendakwaan atau prosiding undang™ undang lain boleh dibawa, dijalan atau disenggara dalam mana-mana mahkamah terhadap mana-mana pegawai awam sama ada atas sifat dirinya sendiri atau atas sifat jawatannya bagi atau oleh kerana atau mengenai apa-apa perbuatan yang diperintah atau dilakukan olehnya atau berupa sebagai telah diperintah atau dilakukan olehnya dalam tempoh darurat bagi maksud menjamin ketenteraman atau keselamatan awam atau bagi maksud menguatkuasakan mana-mana peraturan, perintah, kaedah, undang-undang kecil, arahan atau notis yang dibuat atau dikeluarkan di bawah Akta ini, dan tiada apa jua guaman, pendakwaan atau prosiding undang-undang lain boleh dibawa dalam mana-mana mahkamah terhadap mana-mana orang lain bagi atau oleh kerana atau mengenai apa-apa perbuatan yang dilakukan atau berupa sebagai telah dilakukan olehnya di bawah mana-mana peraturan-peraturan, perintah, kaedah, undangundang kecil, arahan atau notis mana-mana pegawai awam yang diberi bagi apa-apa maksud seperti tersebut di atas: Dengan syarat bahawa perbuatan pegawai atau orang itu elah dilakukan dengan suci hati dan dengan kepercayaan yang munasabah bahawa perbuatan itu adalah perlu bagi maksud yans dicadang untuk dicapai dengan berbuat demikian.
