s 13 Accrual of right of action in certain tenancies

(1) A tenancy at will shall, for the purposes of this Act, be deemed to be determined at the expiration of a period of one year from the commencement thereof, unless it has previously been determined, and accordingly the right of action of the person entitled to the land subject to the tenancy shall be deemed to have accrued on the date of such determination. (2) A tenancy from year to year or other period, without a lease in writing, shall, for the purposes of this Act, be deemed to be determined at the expiration of the first year or other period, and accordingly the right of action of the person entitled to the land subject to the tenancy shall be deemed to have accrued at the date of such determination. (3) Where any rent has subsequently to the determination of any tenancy been received in respect of the tenancy, the right of action shall be deemed to have accrued on the date of the last receipt of rent. (4) Where any person is in possession of land by virtue of a lease in writing by which a rent of not less than ten ringgit is reserved, and the rent is received by some person wrongfully claiming to be entitled to the land in reversion immediately expectant on the determination of the lease, and no rent is subsequently received by the person rightfully so entitled, the right of action of the last-named person to recover the land shall be deemed to have accrued at the date when the rent was first received by the person wrongfully claiming as aforesaid and not at the date of the determination of the lease. (5) This section shall not apply to any tenancy at will or lease granted by a Ruler or Yang di-Pertua Negeri or by the Government or the Government of any State.

Hak tindakan terakru dalam hal sewaan tertentu

(1) Sesuatu sewaan dengan kehendak hendaklah, bagi maksud Akta ini, disifatkan sebagai telah ditamatkan apabila tamatnya tempoh satu tahun dari tarikh sewaan itu mula berkuat kuasa, melainkan ia telah ditamatkan terlebih dahulu, dan dengan itu hak tindakan bagi orang yang berhak mendapat tanah yang tertakluk kepada sewaan itu hendaklah disifatkan sebagai telah terakru pada tarikh penamatan tersebut. (2) Suatu sewaan dari setahun ke setahun atau mengikut tempoh masa lain, tanpa pajakan secara bertulis, hendaklah, bagi maksud Akta ini, disifatkan sebagai telah ditamatkan apabila tamatnya tempoh tahun yang pertama atau tempoh masa lain itu, dan dengan itu hak tindakan bagi orang yang berhak kepada tanah yang tertakluk kepada sewaan itu hendaklah disifatkan sebagai telah terakru pada tarikh penetapan tersebut. (3) Jika apa-apa sewa berkenaan dengan sesuatu sewaan telah diterima selepas tamatnya tempoh sewaan tersebut, maka hak tindakan hendaklah disifatkan sebagai telah terakru pada tarikh penerimaan sewa itu yang terakhir. (4) Jika mana-mana orang memiliki tanah menurut suatu pajakan secara bertulis dengan sewa yang tidak kurang daripada sepuluh ringgit dirizabkan, dan sewa itu diterima oleh beberapa orang yang dengan salahnya menuntut sebagai berhak mendapat kembalian tanah yang akan diperoleh sebaik sahaja pajakan itu tamat, dan tiada apa-apa sewa kemudiannya diterima oleh orang yang dengan sahnya berhak sedemikian, maka hak tindakan bagi orang yang terakhir dinamakan itu untuk mendapat kembali tanah tersebut hendaklah disifatkan sebagai telah terakru pada tarikh sewa itu mula-mulanya diterima oleh orang yang dengan salahnya menuntut yang tersebut dahulu dan tidak pada tarikh tamatnya pajakan itu. (5) Seksyen ini tidak terpakai bagi apa-apa sewaan dengan kehendak atau pajakan yang diberi oleh Raja atau Yang Dipertua Negeri atau oleh Kerajaan atau Kerajaan mana-mana Negeri.
