s 12 Notice and claim
(1) Except as provided in this section proceedings for the recovery of compensation for an injury under this Act shall not be maintainable unless notice of the accident in respect of which such compensation is claimed has been given to the employer within seven days after the happening thereof and unless a claim for compensation with respect to such accident has been made within six months from the happening of the accident causing the injury, or, in case of death, within six months from the date of the death.
(2) No notice to the employer shall be necessary where a fatal accident has occurred.
(3) The want of or any defect or inaccuracy in such notice shall not be a bar to the maintenance of such proceedings if the employer is proved to have had knowledge of the accident from any other source at or about the time of the accident, or if it is found in the proceedings for settling the claim that the employer is not, or would not be, if a notice or amended notice were then given and the hearing postponed, prejudiced in his defence by such want, defect or inaccuracy, or that such want, defect or inaccuracy was occasioned by mistake, absence from Malaysia or other reasonable cause.
(4) The failure to make a claim within the period above specified shall not be a bar to the maintenance of such proceedings if it is found that the failure was occasioned by mistake, absence from Malaysia or other reasonable cause.
(5) Notice to the employer, or if there is more than one employer, to one of such employers, in respect of an injury may be given either in writing or orally or to the foreman or other person under whose supervision the workman was employed, or to any person designated for the purpose by the employer, and shall state in ordinary language the cause of the injury and the date at which the accident happened.
(6) The notice if in writing may be given by delivering the same at, or sending it by registered post addressed to, the residence or place of business of the person to whom it is to be given.
(7) Where the employer is a body of persons, corporate or unincorporate, the notice, if in writing, may be given by delivering it or by sending it by registered post addressed to the employer, at the office, or, if there be more than one office, any one of the offices, of such body.
(8) The notice hereby required may be given by the Commissioner on behalf of any workman, and a notice so given shall have the same effect as if given by the workman himself.

(1) Kecuali sebagaimana yang diperuntukkan Notis dan bampsk kerania rkeciteranı di bavih kka im yor y tidaklah boleh disenggarakan melainkan jika notis mengenai kemalangan yang berkenaan dengannya pampasan itu dituntut telah diberi kepada majikan dalam masa tujuh hari selepas ianya berlaku dan melainkan jika sesuatu tuntutan bagi. mendapatkan pampasan berkenaan dengan kemalangan itu telah dibuat dalam masa enam bulan dari berlakunya kemalangan yang menyebabkan kecederaan itu, atau, dalam hal kematian, dalam masa enam bulan dari tarikh kematian itu
(2) Tiada notis kepada majikan adalah perlu jika kemalangan maut telah berlaku.
(3) Sesuatu ketiadaan atau apa-apa kecacatan atau ketidaktepatan dalam notis sedemikian tidaklah boleh menjadı suatu halangan terhadap penyenggaraan prosiding sedemıkian jıka majıkan ıtu dıbuktıkan sebagai mengetahui tentang kemalangan dari apa-apa sumber lain pada atau kira-kira pada masa kemalangan itu, atau jika didapati dalam prosiding bagi menyelesaikan tuntutan itu bahawa majikan tidak, atau tidak akan, jika suatu notis atau notis yang dipinda diberi pada masa itu dan perbicaraan itu ditangguhkan, dimudaratkan dalam pembelaannya oleh ketiadaan, kecacatan atau ketidaktepatan itu, atau bahawa ketiadaan, kecacatan atau ketidaktepatan itu berlaku kerana khilaf, ketiadaan dari Malaysia atau sebab munasabah lain.

(4) Kegagalan membuat sesuatu tuntutan dalam tempoh yang dinyatakan di atas tidaklah boleh menjadi halangan penyenggaraan prosiding sedemikian jika didapati bahawa kegagalan itu adalah disebabkan oleh khilaf, ketiadaan dari Malaysia atau sebab munasabah lain.
(5) Notis kepada majikan, atau jika terdapat lebih daripada seorang majikan, kepada salah seorang daripada majikan-majikan itu, berkenaan dengan sesuatu kecederaan bolehlah diberi sama ada secara bertulis atau lisan atau kepada formen atau orang lain yang di bawah penyeliaannya pekerja itu digaji, atau kepada mana-mana orang yang ditugaskan oleh majikan bagi maksud itu, dan hendaklah menyatakan dalam bahasa biasa sebab kecederaan itu dan tarikh kemalangan itu berlaku.
(6) Notis itu jika bertulis bolehlah diberi dengan menghantarserahkannya di, atau menghantarnya melalui pos berdaftar yang dialamatkan kepada, rumah kediaman atau tempat perniagaan orang yang kepadanya ia hendak diberi.
(7) Jika majikan itu adalah suatu kumpulan orang, diperbadankan atau tidak diperbadankan, notis itu, jika bertulis, bolehlah diberi menghantarserahkannya atau dengan menghantarnya melalui pos berdaftar yang dialamatkan kepada majikan itu, di pejabat, atau, jika terdapat lebih daripada satu pejabat, mana-mana satu daripada pejabat-pejabat, kumpulan itu.
(8) Notis yang dikehendaki di sini bolehlah diberi oleh Pesuruhjaya bagi pihak mana-mana pekerja, dan sesuatu notis yang diberi sedemikian hendaklah mempunyai natijah yang serupa seolah-olah diberi oleh pekerja itu sendiri. Notis oleh
