s 22 Contribution for cost of maintenance, treatment and rehabilitation

(1) Where a Magistrate makes an order requiring any person to reside at a Rehabilitation Centre, he may, at the time of making such order, or at any time thereafter during the currency of such order make an order, requiring such person, or where such person is a minor, requiring his parent or guardian, to pay such amount as may be specified in the order to the Director General as contribution towards the cost of the maintenance, treatment and rehabilitation of such person at the Rehabilitation Centre. (2) Before making an order under subsection (1), the Magistrate shall consider the report of a Rehabilitation Officer relating to the circumstances of the person against whom the order is proposed to be made (a copy of which report shall be supplied to such person) and give an opportunity to such person to make representations in the matter to the Magistrate. (3) A Magistrate may, on the application of any person against whom an order under subsection (1) has been made, rescind, make anew or vary the order as the Magistrate deems just. (4) Any amount due and owing under this section shall be a civil Drug Dependants (Treatment and Rehabilitation) debt due and owing to, and shall be recoverable by, the Government.

Sumbangan bagi kos saraan, rawatan dan pemulihan

(1) Jika Majistret membuat sesuatu perintah menghendaki mana-mana orang supaya tinggal di Pusat Pemulihan, dia boleh, pada masa membuat perintah itu, atau pada bila-bila masa selepas itu dalam masa perintah itu berkuat kuasa, membuat suatu perintah, menghendaki orang itu, atau jika orang-orang itu adalah seorang belum dewasa, menghendaki ibu bapanya atau penjaganya, membayar apa-apa amaun yang dinyatakan dalam perintah itu kepada Ketua Pengarah sebagai sumbangan terhadap kos saraan, rawatan dan pemulihan orang itu di Pusat Pemulihan itu. (2) Sebelum membuat sesuatu perintah di bawah subseksyen (1), Majistret hendaklah menimbangkan laporan seseorang Pegawai Pemulihan berhubungan dengan hal keadaan orang yang terhadapnya perintah itu dicadang hendak dibuat (satu salinan laporan itu hendaklah diberi kepada orang itu) dan memberi peluang kepada orang itu untuk membuat representasi mengenai perkara itu kepada Majistret. (3) Majistret boleh, atas permohonan mana-mana orang yang terhadapnya suatu perintah di bawah subseksyen (1) telah dibuat, membatalkan, membuat perintah baru atau mengubah perintah itu sebagaimana difikirkan patut oleh Majistret. (4) Apa-apa amaun yang kena dibayar dan terhutang di bawah seksyen ini hendaklah menjadi suatu hutang sivil yang kena dibayar dan terhutang kepada, dan boleh dituntut oleh, Kerajaan.
