s 28 Filing date
(1) The Registrar shall record as the filing date the date of receipt of the application:
Provided that the application contains—
(a) the name and address of the applicant;
(b) the name and address of the inventor;
(c) a description including a sequence listing, if any;
(d) a claim or claims; and
(e) that at the time of receipt of the application the prescribed fee has been paid.
(1A) For the purposes of paragraph (1)(d), where the application comprises more than ten claims, each subsequent claim shall be subject to the payment of the prescribed fee.
(2) Where the Registrar finds that the application made by the applicant does not fulfil the requirement under paragraph (1)(a), (b),
(c) or (d), the Registrar shall request the applicant to file the required correction within the prescribed period.
(2A) Where the Registrar finds that the application made by the applicant does not fulfil the requirement under subsection (1A), the Registrar shall request the applicant to make payment of the prescribed fee for each subsequent claim within the prescribed period.
(3) Where—
(a) the applicant complies with the request of the Registrar to file the required correction under subsection (2), the Registrar shall record as the filing date the date of receipt of the required correction;
(b) the applicant does not comply with the request of the Registrar to file the required correction under subsection (2), the application shall be treated as abandoned;
(c) the applicant complies with the request of the Registrar to make payment of the prescribed fee for each subsequent claim under subsection (2A), the Registrar shall record as the filing date the date of receipt of the application under subsection (1); or
(d) the applicant does not comply with the request of the Registrar to make payment of the prescribed fee for each subsequent claim under subsection (2A), the Registrar shall record as the filing date the date of receipt of the application under subsection (1) for the first ten claims only.
(4) Where the application refers to drawings which in fact are not included in the application, the Registrar shall request the applicant to furnish the missing drawings within the prescribed period.
(5) Where the applicant complies with the request referred to in subsection (4), the Registrar shall record as the filing date the date of receipt of the missing drawings and where the applicant does not so comply, the Registrar shall record as the filing date the date of receipt of the application and make no reference to the said drawings.
(6) The prescribed period referred to in subsections (2), (2A) and (4) shall not be extended by the Registrar under section 82.

Tarikh pemfailan
(1) Pendaftar hendaklah merekodkan tarikh permohonan diterima sebagai tarikh pemfailan:
Dengan syarat bahawa permohonan itu mengandungi—
(a) nama dan alamat pemohon;
(b) nama dan alamat pereka cipta;
(c) suatu perihalan termasuk suatu senarai jujukan, jika ada;
(d) suatu tuntutan atau tuntutan-tuntutan; dan
(e) bahawa semasa menerima permohonan itu fi yang ditetapkan telah dibayar.
(1A) Bagi maksud perenggan (1)(d), jika permohonan itu mengandungi lebih daripada sepuluh tuntutan, setiap tuntutan yang berikutnya hendaklah tertakluk pada pembayaran fi yang ditetapkan.
(2) Jika Pendaftar mendapati bahawa permohonan yang dibuat oleh pemohon tidak memenuhi kehendak di bawah perenggan (1)(a), (b),
(c) atau (d), Pendaftar hendaklah meminta pemohon untuk memfailkan pembetulan yang dikehendaki dalam tempoh yang ditetapkan.
(2A) Jika Pendaftar mendapati bahawa permohonan yang dibuat oleh pemohon tidak memenuhi kehendak di bawah subseksyen (1A), Pendaftar hendaklah meminta pemohon untuk membuat pembayaran fi yang ditetapkan bagi setiap tuntutan yang berikutnya dalam tempoh yang ditetapkan.
(3) Jika—
(a) pemohon mematuhi permintaan Pendaftar untuk memfailkan pembetulan yang dikehendaki di bawah subseksyen (2), Pendaftar hendaklah merekodkan tarikh penerimaan pembetulan yang dikehendaki sebagai tarikh pemfailan;
(b) pemohon tidak mematuhi permintaan Pendaftar untuk memfailkan pembetulan yang dikehendaki di bawah subseksyen (2), permohonan itu hendaklah dikira sebagai ditinggalkan;
(c) pemohon mematuhi permintaan Pendaftar untuk membuat pembayaran fi yang ditetapkan bagi setiap tuntutan yang berikutnya di bawah subseksyen (2A), Pendaftar hendaklah merekodkan tarikh penerimaan permohonan di bawah subseksyen (1) sebagai tarikh pemfailan; atau
(d) pemohon tidak mematuhi permintaan Pendaftar untuk membuat pembayaran fi yang ditetapkan bagi setiap tuntutan yang berikutnya di bawah subseksyen (2A), Pendaftar hendaklah merekodkan tarikh penerimaan permohonan di
bawah subseksyen (1) bagi sepuluh tuntutan pertama sahaja sebagai tarikh pemfailan.
(4) Jika permohonan itu adalah berkenaan dengan lukisan yang sebenarnya tidak disertakan bersama permohonan itu, Pendaftar hendaklah meminta pemohon memberi lukisan yang hilang itu dalam tempoh yang ditetapkan.
(5) Jika pemohon mematuhi permintaan yang disebutkan dalam subseksyen (4), Pendaftar hendaklah merekodkan tarikh terimanya lukisan yang hilang itu sebagai tarikh pemfailan dan jika pemohon itu tidak mematuhinya, Pendaftar hendaklah merekodkan tarikh terimanya permohonan itu sebagai tarikh pemfailan dan rujukan tidak boleh dibuat kepada lukisan tersebut.
(6) Tempoh yang ditetapkan yang disebut dalam subseksyen (2),
(2A) dan (4) tidak boleh dilanjutkan oleh Pendaftar di bawah seksyen 82.
