(1) Where an application for a patent has a filing date and is not withdrawn, the Registrar shall examine the application and determine whether it complies with the requirements of this Act and the regulations made under this Act which are designated by such regulations as formal requirements for the purposes of this Act.
(2) If the Registrar, as a result of the examination under subsection (1), finds that not all the formal requirements are complied
with, he shall give an opportunity to the applicant to make any observation on such finding and to amend the application within the prescribed period so as to comply with those requirements, and if the applicant fails to do so the Registrar may refuse the application.

Pemeriksaan permulaan
(1) Jika sesuatu permohonan bagi mendapatkan paten mempunyai tarikh pemfailan dan tidak ditarik balik, Pendaftar hendaklah memeriksa permohonan itu dan memutuskan sama ada ia mematuhi kehendak Akta ini dan peraturan-peraturan yang dibuat di bawah Akta ini yang telah ditentukan oleh peraturan-peraturan itu sebagai kehendak formal bagi maksud Akta ini.
(2) Jika Pendaftar, hasil daripada pemeriksaan di bawah subseksyen (1), mendapati bahawa tidak semua kehendak formal telah dipatuhi, dia hendaklah memberikan peluang kepada pemohon untuk memberikan apa-apa pandangan tentang dapatan itu dan untuk meminda permohonan itu dalam tempoh yang ditetapkan supaya kehendak itu dipatuhi, dan jika pemohon tidak berbuat demikian, Pendaftar boleh menolak permohonan itu.
