(1) (a) Where by a scheme under section 51 takaful business of an operator is transferred to another, the transferee shall within one month after the scheme takes effect, lodge with the Director General-
(i) statements of the assets and liabilities of each operator concerned as at the time immediately before the transfer, signed on behalf of the operator and, in the case of the transferor, indicating whether the transfer is of the whole of the transferor's business and, if not, the extent to which the transferor's assets and liabilities relate to the business transferred;
(ii) a copy of the scheme as confirmed by the Court, and a certified copy of the order of the Court confirming the scheme;

(iv) a statutory declaration made by the chairman of directors of the transferee, or by its principal officer,fully setting forth every paymentmad or to be made to any person whatsoever or account of the transfer, and stating that, to the best of his belief, no other payment beyona those so set forth has been, or is to be, made on account thereof by or with the knowledge of any operator concerned.
(b) In paragraph (a) (iv) references to the making of a payment include references to the transfer of property or rights of any description.
(2) On the confirmation of a scheme under section 51 each of the operators concerned shall (unless it is an unincorporated company) file a copy of the scheme with the Registrar of Companies or, in the case societies registered under the Co-operative Societies Act, with the Registrar under that Act.

(1) (a) Jika melalui skim di bawah seksyen 51 Dokumenperniagaan takaful bagi sesuatu pengendali dipindah- hendaklah milik kepada seorang pengendali lain, penerima pindah- difailkan milik hendaklah dalam masa satu bulan setelah skim apabila disahkan. Pengarah-
(i) pernyataan aset dan liabiliti setiap pengendali yang berkenaan sebagaumana pada masa sebelum sahaja pindahmilik atu, ditandatangana bagi pihak pengendali dan, dalam hal pemindahmilik, menunjukkan sama ada pindahmilik itu adalah mengenai ikeseluruhan perniagaan pemindahmilik dan, jka tidak, takat aset oar liabiliti pemindahmılik yang berhubungan dengan perniagaan yang dipindahmilik itu;
(ii) satu salinan skim sebagaimana yang disahkan oleh Mahkamah, dan satu salinan perintah Mahkamah yang diperakui yang mengesahkan
(iii) salinan sesuatu laporan aktuari atau laporanlaporan atas mana"skim itu diasaskan (iaitu laporan yang dibuat sejak salinan skim itu diserahsimpan di bawah subseksyen (1) seksyen 52); atau

(iv) suatu akuan berkanun yang dibuat oleh pengerusi pengarah penerima pindahmilik; atau oleh pegawai utamanya yang menyatakan dengan sepenuhnya tiap-tiap bayaran yang dibuat atau yang akan dibuat kepada mana; mana jua orang oleh kerana pindahmilik itu; dan menyatakan bahawa, sepanjang yang dia peroayai, tiada apa-apa bayaran lain selain dari yang dinyatakan itu telah atau akan dibuat oleh kerananya itu oleh atau dengan pengetahuan pengendali yang berkenaan.
(b) Dalam perenggan (a) (iv) sebutan-sebutan pembuatan pembayaran termasuklah sebutan-sebutan mengenai pemindahan apa-apa jenis harta atau hak.
(2) Apabila suatu skim di bawah seksyen 52 disahkan setiap_pengendali yang berkenaan hendaklah (melain-. kan jüka ia adalah swatu syarikat tak diperbadankan) memfailkan satu salinan skim itu dengan Pendaftar Syarikat atau, dalam hal pertubuhan yang didaftarkan di bawah Akta Koperasi, dengan Pendaftar di bawah Akta itu.
