National Forestry Act 1984 s 105

s 105 Certificate of the Director as to the value of forest produce, etc.

(1) In any proceedings under this Act a certificate signed by the Director stating— (a) the value of any forest produce; (b) the amount of royalty, premium, cess and other charges payable in respect of any forest produce; (c) the sum payable to the State Authority under subsection 24(2); (d) the costs of repairing any damage caused by an offender, shall be admissible in evidence and it shall be evidence of its contents, including the facts stated therein, without proof of the signature to such certificate. (2) The provisions of this section shall apply notwithstanding anything contained in any other written law or rule of evidence to the contrary.

Perakuan Pengarah mengenai nilai hasil hutan, dsb.

(1) Dalam sesuatu prosiding di bawah Akta ini suatu perakuan yang ditandatangani oleh Pengarah menyatakan— (a) nilai sesuatu hasil hutan; (b) amaun royalti, premium, ses dan caj lain yang kena dibayar berkenaan dengan mana-mana hasil hutan; (c) jumlah yang kena dibayar kepada Pihak Berkuasa Negeri di bawah subseksyen 24(2); (d) kos membaiki sesuatu kerosakan yang disebabkan oleh pesalah, boleh diterima sebagai keterangan dan hendaklah menjadi keterangan mengenai isi kandungannya, termasuk fakta yang ternyata di dalamnya, tanpa bukti mengenai tandatangan atas perakuan sedemikian. (2) Peruntukan seksyen ini hendaklah terpakai walau apa pun yang terkandung dalam mana-mana undang-undang bertulis lain atau kaedah keterangan yang berlawanan.
