(1) A forest officer not below the rank of Forester or a police officer may arrest without warrant any person whom he has reason to believe to have committed a forest offence, if the person refuses to furnish his name and address or furnishes an address out of Malaysia or there are reasonable grounds for believing that he has furnished a false name or address or that he is likely to abscond; and may seize any thing which he considers it necessary to seize in relation to the evidence necessary to establish the commission of any such offence.
(2) When any person has been arrested under subsection (1) he shall thereafter be dealt with as provided by the Criminal Procedure Code [Act 593].
(3) Any forest officer not below the rank of Assistant District Forest Officer, any police officer not below the rank of Sergeant and any officer in charge of a police station may, in relation to
any investigation in respect of any forest offence, without order of the Public Prosecutor, exercise the special powers in relation to police investigations given by the Criminal Procedure Code in any seizable case.

Kuasa menangkap, menyita dan menyiasat
(1) Seorang pegawai hutan yang berpangkat tidak rendah daripada Pengawas Hutan atau seseorang pegawai polis boleh menangkap tanpa waran mana-mana orang yang dia mempunyai alasan untuk mempercayai telah melakukan suatu kesalahan hutan, jika orang itu enggan menyatakan nama dan alamatnya atau menyatakan suatu alamat di luar Malaysia atau terdapat alasan yang munasabah bagi mempercayai bahawa dia telah menyatakan nama palsu atau alamat palsu atau dia mungkin akan melarikan diri; dan boleh menyita apa-apa benda yang difikirkannya perlu disita berhubungan dengan keterangan yang perlu bagi membuktikan berlakunya mana-mana kesalahan itu.
(2) Apabila mana-mana orang telah ditangkap di bawah subseksyen (1) dia hendaklah selepas itu dibicarakan sebagaimana diperuntukkan oleh Kanun Tatacara Jenayah [Akta 593].
(3) Mana-mana pegawai hutan yang berpangkat tidak rendah daripada Penolong Pegawai Hutan Daerah, mana-mana pegawai polis yang berpangkat tidak rendah daripada Sarjan dan mana-mana pegawai yang menjaga balai polis boleh, berhubungan dengan apa-apa penyiasatan mengenai apa-apa kesalahan hutan, tanpa perintah Pendakwa Raya, menjalankan kuasa khas berhubungan dengan penyiasatan polis yang diperuntukkan oleh Kanun Tatacara Jenayah dalam mana-mana kes boleh tangkap.
