s 30 Council may permit opticians to prescribe and dispense contact lenses

(1) Notwithstanding subsection 29(2), the Council may, on the application of a registered optician— (a) who has been prescribing and dispensing contact lenses for a period of three years or more immediately prior to the date of coming into force of this Act; or (b) who has been prescribing and dispensing contact lenses for a period of less than three years immediately prior to the date of coming into force of this Act and, subject to subsection (2), has passed, within a period of six years from the date of coming into force of this Act, such examination as may be set by the Council, permit him to continue prescribing and dispensing contact lenses. (2) No person shall be allowed to sit for the examination referred to in paragraph (1)(b) unless he has completed, within one year of the date of coming into force of this Act, a training course approved by the Council and has been engaged in the practice of prescribing and dispensing contact lenses for a period which shall not be less than the difference between a period of three years and the period during which he has been prescribing and dispensing contact lenses immediately prior to the date of coming into force of this Act. (3) Notwithstanding subsection 29(2) and solely for the purposes of paragraph (1)(b), a registered optician referred to in that paragraph may continue to prescribe and dispense contact lenses for a period not exceeding six years from the date of coming into force of this Act. (4) Notwithstanding subsection 29(2) and subsection (1) of this section, the Council may, on the application of a registered optician and upon being satisfied that the applicant has received proper training, and is competent, in the prescribing and dispensing of contact lenses, permit him to prescribe and dispense contact lenses. (5) The Council may, before giving its permission under subsection (4), require the applicant to pass such examination as may be set by the Council. (6) The permission referred to in subsections (1) and (4) shall be given in writing in such form as the Council may determine.

Majlis boleh membenarkan juruoptik mempreskripsi dan mendispens kanta lekap

(1) Walau apa pun subseksyen 29(2), Majlis boleh, atas permohonan seseorang juruoptik berdaftar— (a) yang telah mempreskripsi dan mendispens kanta lekap selama tempoh tiga tahun atau lebih sebaik sebelum Akta ini mula berkuat kuasa; atau (b) yang telah mempreskripsi dan mendispens kanta lekap selama tempoh yang kurang daripada tiga tahun sebaik sebelum Akta ini mula berkuat kuasa dan, tertakluk pada subseksyen (2), telah lulus, dalam tempoh enam tahun dari tarikh Akta ini mula berkuat kuasa, peperiksaan yang diadakan oleh Majlis, membenarkannya terus mempreskripsi dan mendispens kanta lekap. (2) Tiada seorang pun boleh dibenarkan menduduki peperiksaan yang disebut dalam perenggan (1)(b) melainkan jika dia telah menamatkan, dalam masa satu tahun dari tarikh Akta ini mula berkuat kuasa, suatu kursus latihan yang diluluskan oleh Majlis dan telah menjalankan amalan mempreskripsi dan mendispens kanta lekap selama suatu tempoh yang tidak boleh kurang daripada perbezaan antara tempoh tiga tahun dengan tempoh dia telah mempreskripsi dan mendispens kanta lekap sebelum Akta ini mula berkuat kuasa. (3) Walau apa pun subseksyen 29(2) dan semata-mata bagi maksud perenggan (1)(b), seseorang juruoptik berdaftar yang disebut dalam perenggan itu boleh terus mempreskripsi dan mendispens kanta lekap selama tempoh yang tidak melebihi enam tahun dari tarikh Akta ini mula berkuat kuasa. (4) Walau apa pun subseksyen 29(2) dan subseksyen (1) seksyen ini, Majlis boleh, apabila permohonan dibuat oleh seseorang juruoptik berdaftar dan apabila Majlis berpuas hati bahawa pemohon telah menerima latihan yang sepatutnya, dan bahawa dia kompeten, dalam mempreskripsi dan mendispens kanta lekap, membenarkannya mempreskripsi dan mendispens kanta lekap. (5) Majlis boleh, sebelum memberikan kebenarannya di bawah subseksyen (4), menghendaki pemohon lulus peperiksaan yang diadakan oleh Majlis. (6) Kebenaran yang disebut dalam subseksyen (1) dan (4) hendaklah diberikan secara bertulis dalam apa-apa bentuk yang ditentukan oleh Majlis.
