s 43 Discharge of fugitive criminal if not returned within three months
If a fugitive criminal who, in pursuance of this Act, has been committed to prison to await his return to any country is not conveyed out of Malaysia within three months after such committal, or if an application for a writ of habeas corpus or for a review has been made to the High Court, after the final determination of such application by the said Court, it shall be lawful for the Minister, upon application made to him by or on behalf of the fugitive criminal, to order such fugitive criminal to be discharged unless sufficient cause is shown to the contrary.

Pelepasan penjenayah buruan jika tidak dipulangkan dalam tempoh tiga bulan
Jika seseorang penjenayah buruan yang, menurut Akta ini, telah dikomitkan ke penjara untuk menunggu pemulangannya ke manamana negara tidak dibawa keluar dari Malaysia dalam masa tiga bulan selepas pengkomitan itu, atau jika sesuatu permohonan bagi mendapatkan writ habeas corpus atau bagi mendapatkan kajian semula telah dibuat kepada Mahkamah Tinggi, selepas pemutusan muktamad permohonan itu oleh Mahkamah tersebut, adalah sah bagi Menteri, apabila permohonan dibuat kepadanya oleh atau bagi pihak penjenayah buruan itu, memerintahkan penjenayah buruan itu dilepaskan melainkan jika ditunjukkan sebab yang mencukupi yang sebaliknya.
