s 35 Forfeiture of property, etc.

(1) All property, document or computerized data seized in exercise of any power conferred under this Act shall be liable to forfeiture. (2) An order for the forfeiture or for the release of any property, document or computerized data seized in exercise of any power conferred under this Act shall be made by the court before which the prosecution with regard thereto has been held and an order for the forfeiture of the property, document or computerized data shall be made if it is proved to the satisfaction of the court that an offence under this Act has been committed and that the property, document or computerized data were the subject matter of or were used in the commission of the offence, notwithstanding that no person may have been convicted of such offence. (3) If there be no prosecution with regard to any property, document or computerized data seized in exercise of any power conferred under this Act, such property, document or computerized data shall be taken and deemed to be forfeited at the expiration of one calendar month from the date of service of a notice to the person from whom the property, document or computerized data were seized indicating that there is no prosecution in respect of such property, document or computerized data, unless a claim thereto is made before that date in the manner set out in subsections (4), (5) and (6). (4) Any person asserting that he is the owner of the property, document or computerized data referred to in subsection (3) and that they are not liable to forfeiture may personally or by his agent authorized in writing give written notice to an Assistant Controller that he claims the same. (5) On receipt of the notice under subsection (4), the Assistant Controller shall refer the notice to the Controller or Deputy Controller, who may, after such enquiries as may be necessary, direct that such property, document or computerized data be released or forfeited or refer the matter to a Magistrate for his decision. (6) The Magistrate to whom a matter is referred under subsection (5) shall issue a summons requiring the person asserting that he is the owner of the property, document or computerized data and the person from whom they were seized to appear before such Magistrate and upon their appearance or default to appear, due service of the summons being proved, the Magistrate shall proceed to the examination of the matter and on proof that an offence under this Act has been committed and that such property, document or computerized data were the subject matter or were used in the commission of such offence shall order the same to be forfeited and shall, in the absence of such proof, order their release. (7) All things forfeited or deemed to be forfeited shall be delivered to the Assistant Controller and shall be disposed of in accordance with the directions of the Controller. (8) Where any goods seized in exercise of the powers, conferred by this Act are of a perishable nature or where the custody of such goods involves unreasonable expense and inconvenience, such goods may be sold at any time and the proceeds of the sale held to abide by the result of any prosecution or claim under this section.

Pelucuthakan harta, dsb.

(1) Segala harta, dokumen atau data berkomputer yang disita pada menjalankan apa-apa kuasa yang diberikan di bawah Akta ini boleh dilucuthakkan. (2) Suatu perintah bagi pelucuthakan atau bagi pelepasan apa-apa harta, dokumen atau data berkomputer yang disita pada menjalankan apa-apa kuasa yang diberikan di bawah Akta ini hendaklah dibuat oleh mahkamah yang di hadapannya pendakwaan berkenaan dengan harta, dokumen atau data berkomputer itu telah diadakan dan suatu perintah bagi pelucuthakan harta, dokumen atau data berkomputer itu hendaklah dibuat jika dibuktikan sehingga mahkamah berpuas hati bahawa suatu kesalahan di bawah Akta ini telah dilakukan dan bahawa harta, dokumen atau data berkomputer itu ialah hal perkara atau telah digunakan dalam melakukan kesalahan itu, walaupun tiada seorang pun telah disabitkan atas kesalahan itu. *CATATAN—lihat subseksyen 22(2) Akta Jualan Langsung (Pindaan) 2010 [Akta A1379]. (3) Jika tidak ada pendakwaan berkenaan dengan apa-apa harta, dokumen atau data berkomputer yang telah disita pada menjalankan apa-apa kuasa yang diberikan di bawah Akta ini, harta, dokumen atau data berkomputer itu hendaklah diambil dan disifatkan telah dilucuthakkan apabila habis tempoh satu bulan kalendar dari tarikh penyampaian notis kepada orang yang daripadanya harta, dokumen atau data berkomputer itu disita yang menunjukkan bahawa tidak ada pendakwaan dibuat berkenaan dengan harta, dokumen atau data berkomputer itu, melainkan jika suatu tuntutan terhadapnya dibuat sebelum tarikh itu mengikut cara yang dinyatakan dalam subseksyen (4), (5) dan (6). (4) Mana-mana orang yang menegaskan bahawa dia ialah pemunya harta, dokumen atau data berkomputer yang disebutkan dalam subseksyen (3) dan bahawa harta, dokumen atau data berkomputer itu bukanlah harta, dokumen atau data berkomputer yang boleh dilucuthakkan boleh memberikan notis bertulis secara sendiri atau melalui ejennya yang diberi kuasa secara bertulis kepada seseorang Penolong Pengawal bahawa dia menuntut harta, dokumen atau data berkomputer itu. (5) Apabila notis yang disebut dalam subseksyen (4) diterima, Penolong Pengawal hendaklah merujukkan notis itu kepada Pengawal atau Timbalan Pengawal, yang boleh, selepas apa-apa siasatan yang perlu, mengarahkan supaya harta, dokumen atau data berkomputer itu dilepaskan atau dilucuthakkan atau merujukkan perkara itu kepada Majistret bagi mendapatkan keputusannya. (6) Majistret yang kepadanya sesuatu perkara dirujukkan di bawah subseksyen (5) hendaklah mengeluarkan saman menghendaki orang yang menegaskan bahawa dia ialah pemunya harta, dokumen atau data berkomputer itu dan orang yang daripadanya harta, dokumen atau data berkomputer itu disita supaya hadir di hadapan Majistret itu, dan apabila mereka hadir atau jika mereka ingkar hadir, setelah dibuktikan penyampaian wajar saman itu, Majistret itu hendaklah terus memeriksa perkara itu dan apabila terbukti bahawa suatu kesalahan di bawah Akta ini telah dilakukan dan bahawa harta, dokumen atau data berkomputer itu ialah hal perkara atau telah digunakan dalam melakukan kesalahan itu hendaklah memerintahkan supaya harta, dokumen atau data berkomputer itu dilucuthakkan dan jika tidak terbukti sedemikian hendaklah memerintahkan supaya harta, dokumen atau data berkomputer itu dilepaskan. (7) Segala benda yang terlucut hak atau yang disifatkan telah terlucut hak hendaklah diserahkan kepada Penolong Pengawal dan hendaklah dilupuskan mengikut arahan Pengawal. (8) Jika apa-apa barang-barang yang disita pada menjalankan kuasa yang diberikan di bawah Akta ini adalah daripada jenis yang mudah musnah atau jika penjagaan barang-barang itu melibatkan belanja dan kesusahan yang tidak munasabah, barang-barang itu boleh dijual pada bila-bila masa dan hasil jualan itu dipegang sementara menanti keputusan apa-apa pendakwaan atau tuntutan di bawah seksyen ini.
