Merchant Shipping (Oil Pollution) Act 1994 s 10
No action to enforce a claim in respect of a liability incurred under section 3 shall be considered by any Court in Malaysia unless the action is commenced within three years from the date the pollution damage occurred or within six years from the date of the incident which caused the pollution damage, and where the incident consists of a series of occurrences, the six years’ period shall run from the date of the first such occurrence.
Penghapusan tuntutan
Tiada tindakan untuk menguatkuasakan suatu tuntutan berkenaan dengan liabiliti yang ditanggung di bawah seksyen 3 atau 3A boleh dipertimbangkan oleh mana-mana Mahkamah di Malaysia melainkan jika tindakan itu dimulakan dalam tempoh tiga tahun dari tarikh berlakunya kerosakan pencemaran itu atau dalam tempoh enam tahun dari tarikh insiden yang menyebabkan kerosakan pencemaran itu, dan jika insiden itu terdiri daripada suatu siri kejadian, tempoh enam tahun itu hendaklah bermula dari tarikh kejadian sedemikian yang pertama.
