s 13 Rights of third parties against insurers

(1) Where it is alleged that the owner of a ship has incurred a liability under section 3 while there was in force a contract of insurance or other financial security to which such a certificate as is mentioned in section 11 relates, proceedings to enforce a claim in respect of the liability may be instituted against the person who provided the insurance or other financial security (referred to in this section as “the insurer”). (2) In any proceedings instituted against the insurer by virtue of this section, the insurer may invoke the defences (other than bankruptcy or winding up of the owner) which the owner himself would have been entitled to invoke, and it shall be a defence to prove that the pollution damage resulted from the wilful misconduct of the owner himself. (3) The insurer may limit his liability in respect of claims made against him by virtue of this section in like manner and to the same extent as the owner of a ship may limit his liability under subsection 6(2) even if the owner, in accordance with subsection 6(3), is not entitled to limit his liability. (4) Where the owner of a ship and the insurer each applies to the Court for the limitation of his liability any payment or any deposit of a bank guarantee or security into the Court in pursuance of either application shall be treated as paid or deposited also in pursuance of the other.

Hak pihak ketiga terhadap penanggung insurans

(1) Jika pemunya sesuatu kapal dikatakan telah menanggung liabiliti di bawah seksyen 3 atau 3A semasa berkuat kuasanya suatu kontrak insurans atau cagaran kewangan lain yang dengannya perakuan yang disebutkan dalam seksyen 11 atau 11A, masingmasing, adalah berhubungan, prosiding untuk menguatkuasakan sesuatu tuntutan berkenaan dengan liabiliti itu boleh dimulakan terhadap orang yang mengadakan insurans atau cagaran kewangan lain itu (yang disebut “penangung insurans” dalam seksyen ini). (2) Dalam mana-mana prosiding yang dimulakan terhadap penanggung insurans menurut kuasa seksyen ini, penanggung insurans boleh menggunakan pembelaan (selain kebankrapan atau penggulungan pemunya) yang pemunya itu sendiri berhak menggunakan, dan bukti bahawa kerosakan pencemaran itu ialah akibat daripada salah laku sengaja pemunya itu sendiri hendaklah menjadi suatu pembelaan. (3) Penginsurans boleh membataskan liabilitinya berkenaan dengan tuntutan yang dibuat terhadapnya menurut kuasa seksyen ini mengikut cara yang sama dan sehingga takat yang sama sebagaimana pemunya kapal boleh membataskan liabilitinya di bawah subseksyen 6(2) atau 6A(2), mengikut mana-mana yang berkenaan, walaupun pemunya itu, mengikut subseksyen 6(3) atau 6A(3), mengikut manamana yang berkenaan, tidak berhak untuk membataskan liabilitinya. (4) Jika pemunya kapal dan penginsurans masing-masing memohon kepada Mahkamah bagi pembatasan liabilitinya apa-apa pembayaran, atau apa-apa pendepositan jaminan bank atau cagaran ke dalam Mahkamah menurut mana-mana satu permohonan itu hendaklah dikira sebagai telah juga dibayar atau didepositkan menurut yang satu lagi.
