Merchant Shipping (Oil Pollution) Act 1994 s 28

s 28 Offences by body corporate

Where an offence under this Act or any regulations made thereunder has been committed by a body corporate, any person who at the time of the commission of the offence was a director, manager, secretary or other similar officer of the body corporate or any person who was purporting to act in such capacity shall, as well as such body corporate, be deemed to be guilty of that offence unless he proves that the offence was committed without his consent or connivance and that he exercised all due diligence to prevent the commission of the offence as he ought to have exercised, having regard to the nature of his functions in that capacity and to all the circumstances.

Kesalahan oleh pertubuhan perbadanan

Jika suatu kesalahan di bawah Akta ini atau mana-mana peraturan yang dibuat di bawahnya telah dilakukan oleh pertubuhan perbadanan, mana-mana orang yang pada masa kesalahan itu dilakukan ialah pengarah, pengurus, setiausaha atau pegawai serupa itu yang lain bagi pertubuhan perbadanan itu atau mana-mana orang yang berupa sebagai bertindak atas sifat sedemikian, serta juga pertubuhan perbadanan itu, hendaklah disifatkan telah melakukan kesalahan tersebut melainkan jika dia membuktikan bahawa kesalahan itu telah dilakukan tanpa persetujuan atau pembiarannya dan bahawa dia telah menjalankan segala daya usaha untuk mencegah pelakuan kesalahan itu sebagaimana yang patut dijalankan olehnya, setelah mengambil kira jenis fungsinya atas sifat itu dan setelah mengambil kira segala hal keadaan.
