s 13 Establishment of the Standards and Accreditation Council and its functions

(1) There shall be established a Council to be known as the Malaysian Standards and Accreditation Council consisting of the following members appointed by the Minister: (a) a Chairman; (b) a Deputy Chairman; (c) a representative of the successor company; (d) five representatives of the Government; and (e) not more than seven other members who, in the opinion of the Minister, have wide experience or special knowledge in matters relating to the functions, powers and activities of the Council. (2) The Director General shall be an ex officio member of the Council. (3) Subject to the direction and control of the Minister, the duties of the Council shall be— (a) to advise the Minister in respect of standardization policies, programmes, schemes, projects and activities; (b) to advise, and submit recommendations for the consideration and approval of, the Minister, in respect of programmes, schemes, projects and activities to promote industrial efficiency and development, and for consumer protection, through standardization activities; (c) to advise the Minister in respect of standard specifications for commodities, processes, practices and services; (d) to advise the Minister on the priorities in respect of standardization to ensure maximum effectiveness; (e) to advise the Minister on the effective implementation of standard specifications for commodities, processes, practices and services; (f) to submit for the consideration and approval of the Minister, criteria and procedures relating to the preparation, approval, acceptance and designation of voluntary standards in Malaysia; (g) to submit for the consideration and approval of the Minister, criteria and procedures relating to the accreditation of testing laboratories, calibration laboratories, organizations engaged in conformity assessment and organizations engaged in training of personnel in conformity assessment; (h) to submit for the consideration and approval of the Minister, criteria and procedures for the registration of persons engaged in conformity assessment; (i) to advise the Minister on the promotion and implementation of accreditation programmes; (j) to advise, and submit recommendations for the consideration and approval of, the Minister in respect of programmes, schemes, projects and activities to promote industrial testing needs and for the development of testing services; (k) to perform any other function as may be determined or delegated by the Minister. (4) A member of the Council shall, unless he sooner resigns or vacates his office or his appointment is sooner revoked, hold office for a term of three years and shall be eligible for reappointment for any successive periods not exceeding three years. (5) In the event of the Chairman being absent or unable to act due to illness or any other cause or if the office of the Chairman is vacant, the Deputy Chairman shall carry out the duties and functions of the Chairman.

Penubuhan Majlis Standard dan Akreditasi dan fungsinya

(1) Suatu Majlis yang akan dikenali sebagai Majlis Standard dan Akreditasi Malaysia hendaklah ditubuhkan yang terdiri daripada anggota yang berikut yang dilantik oleh Menteri: (a) seorang Pengerusi; (b) seorang Timbalan Pengerusi; (c) seorang wakil syarikat pengganti; (d) lima orang wakil Kerajaan; dan (e) tidak lebih daripada tujuh orang anggota lain yang, pada pendapat Menteri, mempunyai pengalaman yang luas atau pengetahuan khusus dalam perkara yang berhubungan dengan fungsi, kuasa dan aktiviti Majlis. (2) Ketua Pengarah hendaklah menjadi seorang anggota ex officio Majlis. (3) Tertakluk kepada arahan dan kawalan Menteri, kewajipan Majlis— (a) untuk menasihati Menteri berkenaan dengan dasar, program, skim, projek dan aktiviti penstandardan; (b) untuk menasihati, dan mengemukakan syor bagi pertimbangan dan kelulusan, Menteri berkenaan dengan program, skim, projek dan aktiviti untuk memajukan kecekapan dan pembangunan perindustrian, dan bagi perlindungan pengguna melalui aktiviti penstandardan; (c) untuk menasihati Menteri berkenaan dengan penentuan standard bagi komoditi, proses, amalan dan perkhidmatan; (d) untuk menasihati Menteri mengenai keutamaan berkenaan dengan penstandardan untuk memastikan keberkesanan yang maksimum; (e) untuk menasihati Menteri mengenai pelaksanaan berkesan penentuan standard bagi komoditi, proses, amalan dan perkhidmatan; (f) untuk mengemukakan bagi pertimbangan dan kelulusan Menteri, kriteria dan tatacara yang berhubungan dengan penyediaan, pelulusan, penerimaan dan penetapan standard sukarela di Malaysia; (g) untuk mengemukakan bagi pertimbangan dan kelulusan Menteri, kriteria dan tatacara yang berhubungan dengan pengakreditasian makmal pengujian, makmal penentukuran, organisasi yang terlibat dalam penilaian ketepatan dan organisasi yang terlibat dalam melatih kakitangan dalam penilaian ketepatan; (h) untuk mengemukakan bagi pertimbangan dan kelulusan Menteri, kriteria dan tatacara bagi pendaftaran orang yang terlibat dalam penilaian ketepatan; (i) untuk menasihati Menteri mengenai penganjuran dan pelaksanaan program akreditasi; (j) untuk menasihati, dan mengemukakan syor bagi pertimbangan dan kelulusan, Menteri berkenaan dengan program, skim, projek dan aktiviti untuk memajukan keperluan pengujian perindustrian dan bagi pembangunan perkhidmatan pengujian; (k) untuk melaksanakan apa-apa fungsi lain yang ditentukan atau diwakilkan oleh Menteri. (4) Seseorang anggota Majlis hendaklah, melainkan jika dia meletakkan atau mengosongkan jawatannya terlebih dahulu atau pelantikannya dibatalkan terlebih dahulu, memegang jawatan bagi tempoh tiga tahun dan layak dilantik semula bagi apa-apa tempoh berturut-turut yang tidak melebihi tiga tahun. (5) Sekiranya Pengerusi tiada atau tidak dapat bertindak kerana sakit atau apa-apa sebab lain atau jika jawatan Pengerusi itu kosong, Timbalan Pengerusi hendaklah menjalankan kewajipan dan fungsi Pengerusi.
