s 31 Appointment and registration of chief executive

(1) Every private higher educational institution shall have a chief executive appointed by the company. (1A) The office of a chief executive shall be located at the main administrative centre of a private higher educational institution. (1B) It shall be the responsibility of a chief executive to inform the Registrar General of the address of his office and any change of that address from time to time. (2) A person appointed as a chief executive shall apply to be registered under this Part. (3) The Registrar General may refuse to register or cancel the registration of a chief executive— (a) if there has been proved against him, or he has been convicted on, a charge in respect of— (i) an offence involving fraud, dishonesty or moral turpitude; (ii) an offence under a law relating to corruption; or (iii) any other offence punishable with imprisonment (in itself only or in addition to or in lieu of a fine) for more than two years; (b) if he is or he becomes a bankrupt; (c) if he is of unsound mind or is otherwise incapable of discharging his duties; (d) if he acts in a manner which is detrimental to the interest of Malaysia, the public or the students; (e) if his appointment under subsection (1) is revoked; or (f) on any other reason that the Registrar General deems proper in the interest of the public or the students. (4) No person shall carry out the duties or functions of a chief executive under this Act where— (a) he is not registered as a chief executive; or (b) his registration as a chief executive has been cancelled under subsection (3) or paragraph 37(1)(bb). (5) Any person who contravenes the provisions of subsection (4) shall be guilty of an offence.

Pelantikan dan pendaftaran ketua eksekutif

(1) Tiap-tiap institusi pendidikan tinggi swasta hendaklah melantik seorang ketua eksekutif. (1A) Pejabat ketua eksekutif hendaklah terletak di pusat pentadbiran utama institusi pendidikan tinggi swasta itu. (1B) Menjadi tanggungjawab ketua eksekutif untuk memaklumkan Ketua Pendaftar tentang alamat pejabatnya dan apa-apa perubahan alamat itu dari semasa ke semasa. (2) Seseorang yang dilantik sebagai ketua eksekutif hendaklah didaftarkan di bawah Bahagian ini. (3) Ketua Pendaftar boleh enggan mendaftarkan atau mengkanselkan pendaftaran seorang ketua eksekutif— (a) jika telah dibuktikan terhadapnya, atau dia telah disabitkan atas, pertuduhan berkenaan dengan— (i) suatu kesalahan yang melibatkan fraud, ketidakjujuran atau keburukan akhlak; (ii) suatu kesalahan di bawah undang-undang berhubungan dengan rasuah; atau (iii) apa-apa kesalahan lain yang boleh dihukum dengan pemenjaraan (atas kesalahan itu sendiri atau sebagai tambahan kepada atau ganti denda) selama lebih daripada dua tahun; (b) jika dia ialah atau menjadi seorang bankrap; (c) jika dia menjadi tidak sempurna akal atau selainnya tidak berupaya untuk menunaikan kewajipannya; (d) jika dia bertindak dalam cara yang memudaratkan kepentingan Malaysia, orang awam atau pelajar; atau (e) jika pelantikannya di bawah subseksyen (1) dibatalkan.
