s 103 Burden of proof as to particular fact
The burden of proof as to any particular fact lies on that person who wishes the court to believe in its existence, unless it is provided by any law that the proof of that fact shall lie on any particular person. ILLUSTRATIONS
(a) A prosecutes B for theft and wishes the court to believe that B admitted the theft to C. A must prove the admission.
(b) B wishes the court to believe that at the time in question he was elsewhere. He must prove it.

Beban membuktikan tentang fakta tertentu
Beban membuktikan tentang apa-apa fakta tertentu terletak pada orang yang berkehendakkan mahkamah mempercayai tentang kewujudan fakta itu, melainkan jika diperuntukkan oleh mana-mana undang-undang bahawa bukti mengenai fakta itu terletak pada mana-mana orang tertentu.
(a) A mendakwa B kerana mencuri dan berhasrat supaya mahkamah mempercayai bahawa B telah mengaku kepada C yang dia telah mencuri. A mestilah membuktikan pengakuan itu.
(b) B berhasrat supaya mahkamah mempercayai bahawa pada masa yang berkenaan itu dia berada di suatu tempat lain. Dia mestilah membuktikannya.
