Evidence Act 1950 s 121
s 121 Judges, Sessions Court Judges and Magistrates
No Judge and, except upon the special order of the High Court, no Sessions Court Judge or Magistrate shall be compelled to answer any questions as to his own conduct in court as Judge, Sessions Court Judge or Magistrate or as to anything which came to his knowledge in court as a Judge, Sessions Court Judge or Magistrate; but he may be examined as to other matters which occurred in his presence whilst he was so acting.
ILLUSTRATIONS
(a) A, on his trial before the High Court, says that a deposition was improperly taken by B, the committing Magistrate. B cannot be compelled to answer questions as to this except upon the special order of the High Court.
(b) A is accused before a Sessions Court of having given false evidence before B, a Sessions Court Judge. B cannot be compelled to say what A said except upon the special order of the High Court.
(c) A is accused of attempting to murder a police officer whilst on his trial before B, a Judge of the High Court. B may be examined as to what occurred.

Hakim, Hakim Mahkamah Sesyen dan Majistret
Tiada Hakim dan, kecuali atas perintah khas Mahkamah Tinggi, tiada Hakim Mahkamah Sesyen atau Majistret boleh dipaksa menjawab apa-apa soalan tentang kelakuannya sendiri di dalam mahkamah sebagai Hakim, Hakim Mahkamah Sesyen atau Majistret atau tentang apa-apa jua yang sampai pada pengetahuannya
di dalam mahkamah sebagai Hakim, Hakim Mahkamah Sesyen atau Majistret; tetapi dia boleh diperiksa tentang perkara lain yang telah berlaku di hadapannya semasa dia menjalankan tugas sedemikian.
(a) A, apabila dibicarakan di hadapan Mahkamah Tinggi, berkata bahawa suatu deposisi telah diambil secara tidak wajar oleh B, Majistret yang menghukum supaya dia dibicarakan di Mahkamah Tinggi. B tidak boleh dipaksa menjawab soalan tentang ini kecuali atas perintah khas Mahkamah Tinggi.
(b) A dituduh di hadapan Mahkamah Sesyen kerana memberikan keterangan palsu di hadapan B, seorang Hakim Mahkamah Sesyen. B tidak boleh dipaksa untuk mengatakan apa yang telah dikatakan oleh A kecuali atas perintah khas Mahkamah Tinggi.
(c) A dituduh atas percubaan membunuh seorang pegawai polis semasa perbicaraannya di hadapan B, seorang Hakim Mahkamah Tinggi. B boleh diperiksa tentang apa yang telah berlaku.
