Evidence Act 1950 s 128

s 128 Privilege not waived by volunteering evidence

If any party to a suit gives evidence therein at his own instance or otherwise, he shall not be deemed to have consented thereby to such disclosure as is mentioned in section 126; and if any party to a suit or proceeding calls any such advocate as a witness, he shall be deemed to have consented to the disclosure, only if he questions the advocate on matters which but for such question he would not be at liberty to disclose.

Keistimewaan tidak dilepaskan jika keterangan diberikan secara sukarela

Jika mana-mana pihak dalam guaman memberikan keterangan dalam guaman itu, atas kehendaknya sendiri atau selainnya, dia tidak boleh dengan demikian itu disifatkan telah bersetuju terhadap pendedahan seperti yang disebut dalam seksyen 126; dan jika mana-mana pihak dalam guaman atau prosiding memanggil mana-mana peguam bela itu sebagai saksi, dia hendaklah disifatkan telah bersetuju terhadap pendedahan itu hanya jika dia menyoal peguam bela itu mengenai perkara yang, jika tidak kerana soalan itu, peguam bela itu tidak bebas mendedahkannya.
