Syariah Court Evidence (Federal Territories) Act 1997 s 75

s 75 Burden of proof as to particular fact

The burden of proof as to any particular fact lies on that person who wishes the Court to believe in its existence. ILLUSTRATION A wishes the Court to believe that at the time in question he was elsewhere. He must prove it.

Beban membuktikan tentang fakta tertentu

Beban membuktikan tentang apa-apa fakta tertentu terletak pada orang yang berkehendakkan Mahkamah mempercayai tentang kewujudan fakta itu. A berhasrat supaya Mahkamah mempercayai bahawa pada masa yang berkenaan itu dia berada di suatu tempat lain. Dia mestilah membuktikannya.
