Syariah Court Civil Procedure (Federal Territories) Act 1998 s 20

s 20 Misjoinder or nonjoinder of parties

(1) Subject to subsection (2), at any stage of the proceedings in any cause or matter the Court may, as it thinks just and either of its own motion or on application— (a) order any party who has been improperly or unnecessarily made a party or who has for any reason ceased to be a proper or necessary party, to cease to be a party; or (b) order any party who ought to have been joined as a party or whose presence before the Court is necessary to ensure that all matters in dispute in the cause or matter may be effectually and completely determined and adjudicated upon to be added as a party. (2) No person shall be added as a plaintiff without his consent which shall be signified in writing or in such other manner as may be authorized.

Kesalahcantuman dan ketakcantuman pihak

(1) Tertakluk pada subseksyen (2), pada mana-mana peringkat prosiding dalam apa-apa kausa atau perkara Mahkamah boleh, sebagaimana yang difikirkannya adil dan sama ada atas kehendaknya sendiri atau atas permohonan— (a) memerintahkan supaya mana-mana pihak yang telah dijadikan suatu pihak dengan tak patut atau tak perlu atau yang kerana apa-apa sebab telah terhenti menjadi pihak yang patut atau perlu, terhenti menjadi suatu pihak; (b) memerintahkan supaya mana-mana pihak yang sepatutnya telah dicantumkan sebagai suatu pihak atau yang kehadirannya di hadapan Mahkamah perlu untuk memastikan bahawa segala perkara yang dipertikaikan dalam kausa atau perkara itu boleh diputuskan dan dihakimi dengan berkesan dan lengkap ditambahkan sebagai suatu pihak. (2) Tiada seorang pun boleh ditambahkan sebagai plaintif tanpa persetujuannya yang ditandakan secara bertulis atau mengikut apa-apa cara lain sebagaimana yang dibenarkan.
