Syariah Court Civil Procedure (Federal Territories) Act 1998 s 65

s 65 Form of defence

(1) Every defence shall be signed by the defendant or his Peguam Syarie and shall— (a) either admit or deny every material allegation of the fact in the statement of claim; (b) state concisely any new facts on which the defendant relies by way of defence; and (c) raise concisely and without argument any necessary matters of law. (2) A denial under paragraph (1)(a) shall not be evasive but shall answer the point of substance.

Bentuk pembelaan

(1) Tiap-tiap pembelaan hendaklah ditandatangani oleh defendan atau Peguam Syarienya dan hendaklah— (a) sama ada mengaku atau menafikan tiap-tiap pengataan fakta yang matan dalam pernyataan tuntutan; (b) menyatakan dengan ringkas lagi padat apa-apa fakta baru yang dijadikan sandaran oleh defendan sebagai pembelaan; dan (c) membangkitkan dengan ringkas lagi padat dan tanpa hujah apa-apa perkara undang-undang yang perlu. (2) Penafian di bawah perenggan (1)(a) tidak boleh berbentuk mengelak tetapi hendaklah menjawab perkara isi.
