s 11 The Chief Executive Officer and Deputies Chief Executive Officer

(1) The Minister shall appoint any person to be the Chief Executive Officer of the Commission on the terms and conditions as he may determine and may revoke the appointment of any person so appointed. (2) The Chief Executive Officer appointed under subsection (1) shall— (a) be a qualified person as defined in the Legal Profession Act 1976; or (b) possess relevant knowledge or experience in commercial or company matters. (3) The Chief Executive Officer shall be responsible for the dayto-day administration of the Commission. (4) The Minister may appoint such number of Deputies Chief Executive Officer as may be necessary and may revoke the appointment of any person so appointed. (5) The Deputies Chief Executive Officer shall be subject to the direction and control of the Chief Executive Officer and may perform the duties of the Chief Executive Officer under this Act. (6) The Minister may appoint any person referred to in subsection (4) or any other person as he thinks fit to act as the acting Chief Executive Officer for the period when— (a) the office of the Chief Executive Officer is vacant; or (b) the Chief Executive Officer is, for any other reason, unable to perform the duties of his office.

Ketua Pegawai Eksekutif dan Timbalan Ketua Pegawai Eksekutif

(1) Menteri hendaklah melantik mana-mana orang sebagai Ketua Pegawai Eksekutif Suruhanjaya atas terma dan syarat yang ditentukannya dan boleh membatalkan pelantikan mana-mana orang yang dilantik sedemikian. (2) Ketua Pegawai Eksekutif yang dilantik di bawah subseksyen (1) hendaklah— (a) orang berkelayakan sebagaimana yang ditakrifkan dalam Akta Profesion Undang-Undang 1976; atau (b) mempunyai pengetahuan atau pengalaman yang berkaitan dalam perkara komersial atau syarikat. (3) Ketua Pegawai Eksekutif hendaklah bertanggungjawab bagi pentadbiran harian Suruhanjaya. (4) Menteri boleh melantik apa-apa bilangan Timbalan Ketua Pegawai Eksekutif sebagaimana yang perlu dan boleh membatalkan pelantikan mana-mana orang yang dilantik sedemikian. (5) Timbalan Ketua Pegawai Eksekutif hendaklah tertakluk kepada arahan dan kawalan Ketua Pegawai Eksekutif dan boleh melaksanakan kewajipan Ketua Pegawai Eksekutif di bawah Akta ini. (6) Menteri boleh melantik mana-mana orang yang disebut dalam subseksyen (4) atau mana-mana orang lain sebagaimana yang difikirkannya sesuai untuk bertindak sebagai pemangku Ketua Pegawai Eksekutif bagi tempoh apabila— (a) jawatan Ketua Pegawai Eksekutif kosong; atau (b) Ketua Pegawai Eksekutif, atas apa-apa sebab lain, tidak dapat melaksanakan kewajipan jawatannya.
