s 21 Exceptions to political offences

(1) For the purposes of paragraph 20(1)(b), the following offences shall not be held to be offences of a political nature: (a) an offence against the life or person of a Head of State or a member of the immediate family of a Head of State; (b) an offence against the life or person of a Head of Government, or of a Minister of a Government; (c) an offence established under any multilateral international treaty to which Malaysia and the prescribed foreign State are parties and which is declared in the multilateral treaty concerned not to be regarded as an offence of a political nature for the purposes of mutual assistance in criminal matters; (d) any other offence declared by the Minister by order published in the Gazette; and (e) any attempt, abetment or conspiracy to commit any of the offences referred to in paragraphs (a) to (d). (2) The Attorney General may restrict the application of any of the provisions made under subsection (1) to a request from a prescribed foreign State that has made similar provision in its laws.

(1) Bagi maksud perenggan 20(1)(b), kesalahan yang berikut tidaklah boleh dianggap sebagai kesalahan yang bersifat politik: (a) suatu kesalahan terhadap nyawa atau diri seseorang Ketua Negara atau anggota keluarga terdekat seseorang Ketua Negara; (b) suatu kesalahan terhadap nyawa atau diri seseorang Ketua Kerajaan, atau seseorang Menteri sesuatu Kerajaan; (c) suatu kesalahan yang diwujudkan di bawah apa-apa triti antarabangsa pelbagai hala yang Malaysia dan Negara asing yang ditetapkan itu ialah pihak kepadanya dan yang diisytiharkan dalam triti pelbagai hala berkenaan tidak dikira sebagai suatu kesalahan yang bersifat politik bagi maksud bantuan bersama dalam perkara jenayah; (d) apa-apa kesalahan lain yang diisytiharkan oleh Menteri melalui perintah yang disiarkan dalam Warta; dan (e) apa-apa percubaan, persubahatan atau komplot untuk melakukan mana-mana kesalahan yang disebut dalam perenggan (a) hingga (d). (2) Peguam Negara boleh menyekat pemakaian mana-mana peruntukan yang dibuat di bawah subseksyen (1) bagi suatu permintaan daripada suatu Negara asing yang ditetapkan yang ielah membuat peruntukan yang seumpama dalam undang-undangnya. pengambilan keterangan bagi prosiding jenayah
