National Archives Act 2003 s 3

s 3 Declaration of federal status

(1) All archives which are in the custody or under the control of the National Archives on or after the coming into operation of this Act are declared to be federal archives. (2) All public records in the custody or under the control of a public office on or after the coming into operation of this Act are declared to be federal public records. (3) The Minister may, from time to time, on the advice of the Director General, by order published in the Gazette, declare any archives or records, as the case may be, to be federal archives or federal records.
