s 14 Decision to initiate investigation

(1) The Government may initiate an investigation, whether on the request of a domestic industry or on its own initiative, only when the Government has determined that there is sufficient evidence of serious injury or threat thereof caused by increased imports. (2) If the Government decides to initiate an investigation under subsection (1), the Government may seek such additional information, as the Government deems necessary. (3) Where the Government decides not to initiate an investigation, the Government shall notify the petitioner in writing of the reasons for not initiating the investigation. (4) Where a petition has been received, the Government shall, from the date of receipt of the petition, decides whether or not to initiate an investigation within such period as prescribed. Where the petition involves complex issues, or if the Government has to seek additional information as provided for in subsection (2), the period may be extended for another period as prescribed.

Keputusan untuk memulakan penyiasatan

(1) Kerajaan boleh memulakan suatu penyiasatan, sama ada atas permintaan suatu industri dalam negeri atau atas inisiatif Kerajaan sendiri, hanya apabila Kerajaan menentukan bahawa terdapat keterangan yang mencukupi tentang kemudaratan yang serius atau ancamannya disebabkan oleh peningkatan import. (2) Jika Kerajaan memutuskan untuk memulakan suatu penyiasatan di bawah subseksyen (1), Kerajaan boleh meminta maklumat tambahan sebagaimana yang Kerajaan sifatkan perlu. (3) Jika Kerajaan memutuskan untuk tidak memulakan suatu penyiasatan, Kerajaan hendaklah memberitahu pempetisyen secara bertulis mengenai sebab-sebab penyiasatan tidak dimulakan. (4) Jika suatu petisyen diterima, Kerajaan hendaklah, dari tarikh petisyen itu diterima, memutuskan sama ada hendak memulakan suatu penyiasatan atau tidak dalam tempoh sebagaimana yang ditetapkan. Jika petisyen itu melibatkan isu yang rumit, atau jika Kerajaan perlu meminta maklumat tambahan sebagaimana yang diperuntukkan dalam subseksyen (2), tempoh itu boleh dilanjutkan bagi tempoh lain sebagaimana yang ditetapkan.
