(1) A person who contravenes any requirement or provision of this Act, commits an offence under this Act and, where no penalty is expressly provided, shall, on conviction, be liable to a fine not exceeding one million ringgit or to imprisonment for a term not exceeding five years or to both.
(2) In the case of a continuing offence the offender, in addition to the penalties under subsection (1), shall, on conviction, be liable to a fine not exceeding five thousand ringgit for every day or part of a day during which the offence continues after conviction.

Penalti am
(1) Seseorang yang melanggar apa-apa kehendak atau peruntukan Akta ini, melakukan suatu kesalahan di bawah Akta ini dan, jika tiada penalti diperuntukkan secara nyata, boleh, apabila disabitkan, didenda tidak melebihi satu juta ringgit atau dipenjarakan selama tempoh tidak melebihi lima tahun atau kedua-duanya.
(2) Dalam hal suatu kesalahan yang berterusan pesalah, sebagai tambahan kepada penalti di bawah subseksyen (1), boleh, apabila disabitkan, didenda tidak melebihi lima ribu ringgit bagi tiap-tiap hari atau sebahagian daripada sehari selama kesalahan itu berterusan selepas disabitkan.
