s 12 Application to close any prescribed solid waste management facilities

(1) Any owner or occupier who intends to close any prescribed solid waste management facilities, may apply to the Director General by submitting a written application and a proposed closure plan to the Corporation. (2) The Corporation may, after the receipt of an application under subsection (1), request the owner or occupier to give further information or document within the period specified in the request or any extension of time granted by the Corporation. (3) If the owner or occupier fails to comply with subsection (2), the application shall be deemed to be withdrawn without affecting the owner or occupier’s right to submit a fresh application. (4) The Corporation shall within sixty days from the receipt of the application under subsection (2), submit a written recommendation to the Director General as to whether or not the application should be allowed. (5) The written recommendation of the Corporation shall specify the reasons for its recommendation and any special conditions which the owner or occupier should be subjected to if the Corporation recommends to the Director General to allow the application. (6) The Director General shall, after considering the application under subsection (1) and having due regard to the recommendation of the Corporation— (a) allow the application with or without conditions; or (b) reject the application and direct the owner or occupier to submit a fresh application and closure plan. (7) Any owner or occupier who closes any prescribed solid waste management facility without the approval of the Director General commits an offence and shall, on conviction, be liable to a fine not less than one hundred thousand ringgit and not exceeding five hundred thousand ringgit or to imprisonment for a term not exceeding five years or to both.

Permohonan untuk menutup mana-mana kemudahan pengurusan sisa pepejal yang ditetapkan

(1) Mana-mana pemunya atau penghuni yang berhasrat untuk menutup mana-mana kemudahan pengurusan sisa pepejal yang ditetapkan, boleh memohon kepada Ketua Pengarah dengan mengemukakan suatu permohonan bertulis dan suatu cadangan pelan penutupan kepada Perbadanan. (2) Perbadanan boleh, selepas menerima permohonan di bawah subseksyen (1), meminta pemunya atau penghuni itu untuk memberikan maklumat atau dokumen lanjut dalam tempoh yang dinyatakan dalam permintaan itu atau apa-apa pelanjutan masa yang diberikan oleh Perbadanan. (3) Jika pemunya atau penghuni itu tidak mematuhi subseksyen (2), permohonan itu hendaklah disifatkan ditarik balik tanpa menyentuh hak pemunya atau penghuni untuk membuat permohonan yang baru. (4) Perbadanan hendaklah dalam masa enam puluh hari dari penerimaan permohonan itu di bawah subseksyen (2), mengemukakan suatu syor bertulis kepada Ketua Pengarah tentang sama ada permohonan itu patut dibenarkan atau tidak. (5) Syor bertulis Perbadanan hendaklah menyatakan sebab bagi syornya dan apa-apa syarat khas yang patut dikenakan ke atas pemunya atau penghuni itu jika Perbadanan mengesyorkan kepada Ketua Pengarah supaya permohonan itu dibenarkan. (6) Ketua Pengarah hendaklah, selepas menimbangkan permohonan di bawah subseksyen (1) dan dengan mengambil kira dengan sewajarnya syor Perbadanan— (a) membenarkan permohonan itu dengan atau tanpa syarat; atau (b) menolak permohonan itu dan mengarahkan pemunya atau penghuni itu mengemukakan suatu permohonan dan pelan penutupan yang baru. (7) Mana-mana pemunya atau penghuni yang menutup mana-mana kemudahan pengurusan sisa pepejal tanpa kelulusan Ketua Pengarah melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak kurang daripada satu ratus ribu ringgit dan tidak melebihi lima ratus ribu ringgit atau dipenjarakan selama tempoh tidak melebihi lima tahun atau kedua-duanya.
