s 36 Closure of a licensed pathology laboratory

(1) Where a licensee intends to close a licensed pathology laboratory, he shall give the Director General not less than thirty days notice in writing of his intention and the date the closure is to take effect. (2) Upon receiving the notice under subsection (1), the Director General may issue an order with regard to the care of a patient’s samples or medical records including a patient’s laboratory results in the licensed pathology laboratory. (3) The licensee shall comply with the order issued under subsection (2) before closing the licensed pathology laboratory. (4) The closure of the licensed pathology laboratory shall take effect on the date specified in the notice under subsection (1) and within fourteen days of that date, the licensee shall surrender the licence. (5) A notice to close the licensed pathology laboratory may be withdrawn by a written notice to the Director General at any time before the closure takes effect. (6) A person who contravenes subsection (1) or (4) commits an offence. (7) A person who contravenes subsection (3) commits an offence and shall, on conviction, be liable— (a) in the case of a sole proprietor— (i) to a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding three years, or to both; and five hundred ringgit for every day or part of a day during which the offence continues after conviction; or (b) in the case of a body corporate or partnership— (i) to a fine not exceeding one hundred thousand ringgit; and one thousand ringgit for every day or part of a day during which the offence continues after conviction.

Penutupan makmal patologi berlesen

(1) Jika pemegang lesen berniat untuk menutup makmal patologi berlesen, dia hendaklah memberi Ketua Pengarah notis secara bertulis tidak kurang daripada tiga puluh hari tentang niatnya dan tarikh penutupan itu mula berkuat kuasa. (2) Apabila menerima notis di bawah subseksyen (1), Ketua Pengarah boleh mengeluarkan suatu perintah berkenaan dengan jagaan sampel atau rekod perubatan pesakit termasuk keputusan makmal pesakit di makmal patologi berlesen itu. (3) Pemegang lesen hendaklah mematuhi perintah yang dikeluarkan di bawah subseksyen (2) sebelum menutup makmal patologi berlesen itu. (4) Penutupan makmal patologi berlesen itu hendaklah mula berkuat kuasa pada tarikh yang dinyatakan dalam notis di bawah subseksyen (1) dan dalam masa empat belas hari dari tarikh itu, pemegang lesen hendaklah menyerahkan lesen itu. (5) Notis untuk menutup makmal patologi berlesen boleh ditarik balik melalui notis bertulis kepada Ketua Pengarah pada bila-bila masa sebelum penutupan itu mula berkuat kuasa. (6) Seseorang yang melanggar subseksyen (1) atau (4) melakukan suatu kesalahan. (7) Seseorang yang melanggar subseksyen (3) melakukan suatu kesalahan dan boleh, apabila disabitkan— (a) dalam hal tuan punya tunggal— (i) didenda tidak melebihi lima puluh ribu ringgit atau dipenjarakan selama tempoh tidak melebihi tiga tahun, atau kedua-duanya; dan melebihi lima ratus ringgit bagi tiap-tiap hari atau itu berterusan selepas sabitan; atau (b) dalam hal pertubuhan perbadanan atau perkongsian— (i) didenda tidak melebihi satu ratus ribu ringgit; dan melebihi satu ribu ringgit bagi tiap-tiap hari atau itu berterusan selepas sabitan.
