s 40 Restriction on use of premise
(1) The premise to which an approval or licence relates shall not be used for any purpose other than the purpose in respect of which the approval or the licence is granted and purposes reasonably incidental thereto.
(2) A person who contravenes subsection (1) commits an offence and shall, on conviction, be liable—
(a) in the case of a sole proprietor—
(i) to a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding three years, or to both; and
five hundred ringgit for every day or part of a day during which the offence continues after conviction; or
(b) in the case of a body corporate or partnership—
(i) to a fine not exceeding one hundred thousand ringgit; and
one thousand ringgit for every day or part of a day during which the offence continues after conviction.

Sekatan ke atas penggunaan premis
(1) Premis yang dimaksudkan oleh suatu kelulusan atau lesen tidak boleh digunakan bagi apa-apa maksud selain maksud yang berkenaan dengannya kelulusan atau lesen itu diberikan dan maksud yang semunasabahnya bersampingan dengannya.
(2) Seseorang yang melanggar subseksyen (1) melakukan suatu kesalahan dan boleh, apabila disabitkan—
(a) dalam hal tuan punya tunggal—
(i) didenda tidak melebihi lima puluh ribu ringgit atau dipenjarakan selama tempoh tidak melebihi tiga tahun, atau kedua-duanya; dan
melebihi lima ratus ringgit bagi tiap-tiap hari atau itu berterusan selepas sabitan; atau
(b) dalam hal pertubuhan perbadanan atau perkongsian—
(i) didenda tidak melebihi satu ratus ribu ringgit; dan
melebihi satu ribu ringgit bagi tiap-tiap hari atau itu berterusan selepas sabitan.
