Pathology Laboratory Act 2007 s 55

s 55 Search and seizure without warrant

If an authorized officer has reasonable cause to believe that by reason of delay in obtaining a search warrant under section 54— (a) the investigation would be affected; (b) the object of the entry is likely to be frustrated; or (c) the book, record, apparatus, equipment, instrument, material, article, sample, blood, blood product, human tissue or fluid or any product of the human body, dialysate, chemical, pharmaceutical, substance or other thing which are the evidence of contravention is likely to be tampered with, removed, damaged or destroyed, he may enter the pathology laboratory or premises and exercise, in respect of the pathology laboratory or premises, all the powers referred to in section 54 as if he were authorized to do so by a warrant issued under that section.

Menggeledah dan menyita tanpa waran

Jika seseorang pegawai yang diberi kuasa mempunyai sebab yang munasabah untuk mempercayai bahawa oleh sebab kelengahan untuk memperoleh waran geledah di bawah seksyen 54— (a) penyiasatan akan terjejas; (b) matlamat kemasukan mungkin terkecewa; atau (c) buku, rekod, perkakas, kelengkapan, alat, material, barang, sampel, darah, hasil darah, tisu atau bendalir manusia atau apa-apa hasil badan manusia, dialisat, bahan kimia, bahan farmaseutikal, bahan atau benda lain yang merupakan bukti tentang pelanggaran itu mungkin diganggu, dialih, dirosakkan atau dimusnahkan, dia boleh memasuki makmal patologi atau premis itu dan menjalankan, berkenaan dengan makmal patologi atau premis itu, semua kuasa yang dirujuk dalam seksyen 54 seolah-olah dia telah diberi kuasa untuk berbuat demikian oleh waran yang dikeluarkan di bawah seksyen itu.
