(1) Except for any of the purposes of this Act or for the purposes of any civil or criminal proceedings under any written law, no member of the Council, officer, employee or agent of the Agency shall disclose any information which has been obtained by him in the course of his duties and which is not published in pursuance of this Act.
(2) Any person who contravenes subsection (1) commits an offence and shall, on conviction, be liable to a fine not exceeding ten thousand ringgit or to imprisonment for a term not exceeding one year or to both.

Obligasi kerahsiaan
(1) Kecuali bagi mana-mana maksud Akta ini atau bagi maksud apa-apa prosiding sivil atau jenayah di bawah mana-mana undang-undang bertulis, tiada anggota Majlis, pegawai, pekerja atau ejen Agensi boleh menzahirkan apa-apa maklumat yang telah diperolehnya semasa menjalankan kewajipannya dan yang tidak disiarkan menurut Akta ini.
(2) Mana-mana orang yang melanggar subseksyen (1) melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi sepuluh ribu ringgit atau dipenjarakan selama tempoh tidak melebihi satu tahun atau kedua-duanya.
