s 122 Savings for certificates and registers

(1) Notwithstanding the repeal and dissolution under section 115 or any provision of this Act to the contrary, every person who, before the appointed day, held a valid certificate issued to him under the repealed Act shall be deemed to be accredited under this Act until the expiry date of the certificate and subject to the terms and conditions attached thereto. (2) Every certificate by virtue of which a person is deemed under subsection (1) to be accredited under this Act shall be deemed to have been issued under this Act; and the Agency may alter the terms and conditions attached to the certificate for the purpose of bringing them into conformity with the policy of the Agency regarding the imposition of conditions on accreditation under this Act. (3) If a higher education provider deemed to be accredited under subsection (1) desires to be accredited under this Act after the expiration of the period for which he is deemed to be accredited under this Act, he may apply to the Agency for a certificate of accreditation in accordance with the regulations made under this Act, notwithstanding anything to the contrary, and his application shall be made and treated as a fresh application and not as an application for renewal of certificate of accreditation. (4) All registers kept and maintained under the repealed Act shall be deemed to be registers kept and maintained under this Act and shall be deemed to form part thereof.

Kecualian bagi perakuan dan daftar

(1) Walau apa pun pemansuhan dan pembubaran di bawah seksyen 115 atau mana-mana peruntukan Akta ini yang berlawanan, tiap-tiap orang yang, sebelum hari ditetapkan, memegang perakuan yang sah yang dikeluarkan kepadanya di bawah Akta dimansuhkan hendaklah disifatkan sebagai diakredit di bawah Akta ini sehingga tamat tempoh perakuan itu dan tertakluk kepada terma dan syarat yang dilampirkan padanya. (2) Tiap-tiap perakuan yang menurut kuasanya seseorang disifatkan di bawah subseksyen (1) diakredit di bawah Akta ini hendaklah disifatkan telah dikeluarkan di bawah Akta ini; dan Agensi boleh mengubah terma dan syarat yang dilampirkan pada perakuan itu bagi maksud menyelaraskannya dengan dasar Agensi mengenai pengenaan syarat akreditasi di bawah Akta ini. (3) Jika suatu pemberi pendidikan tinggi yang disifatkan diakredit di bawah subseksyen (1) berhasrat untuk diakredit di bawah Akta ini selepas tamat tempoh yang baginya dia disifatkan diakredit di bawah Akta ini, dia boleh memohon kepada Agensi bagi suatu perakuan akreditasi mengikut peraturan-peraturan yang dibuat di bawah Akta ini, walau apa pun apa-apa jua yang berlawanan, dan permohonannya hendaklah dibuat dan dianggap sebagai suatu permohonan baru dan bukan sebagai permohonan bagi pembaharuan perakuan akreditasi. (4) Semua daftar yang disimpan dan disenggarakan di bawah Akta dimansuhkan hendaklah disifatkan sebagai daftar yang disimpan dan disenggarakan di bawah Akta ini dan hendaklah disifatkan sebagai sebahagian daripadanya.
