s 42 Revocation of provisional accreditation

(1) Subject to the provisions of this section, the Agency may, at any time, revoke the certificate of provisional accreditation if the higher education provider has breached any condition attached to the certificate of provisional accreditation. (2) A written notice of the intention to revoke the certificate of provisional accreditation shall be served on the higher education provider and the notice shall specify the grounds for such revocation. (3) The higher education provider shall be given an opportunity to make written representations within thirty days from the date of receipt of the notice in subsection (2). (4) After the expiry of the period of thirty days stated in subsection (3) and after considering any representation made, the Agency shallβ€” (a) issue a warning and give directions for the higher education provider to rectify the situation to the satisfaction of the Agency within a specified period; or (b) proceed with the proposed action to revoke the certificate of provisional accreditation. (5) If the higher education provider fails to rectify the situation as required under paragraph (4)(a) the Agency may proceed to revoke the provisional accreditation. (6) The revocation of the certificate provisional accreditation shall not preclude the higher education provider from submitting a fresh application. (7) Where the certificate of provisional accreditation is revoked under this section, the Agency shall give notice to the relevant authority or professional body notifying such revocation including any recommendations as may be necessary.

Pembatalan akreditasi sementara

(1) Tertakluk kepada peruntukan seksyen ini, Agensi boleh, pada bila-bila masa, membatalkan perakuan akreditasi sementara jika pemberi pendidikan tinggi telah melanggar mana-mana syarat yang dilampirkan pada perakuan akreditasi sementara. (2) Suatu notis bertulis mengenai niat untuk membatalkan perakuan akreditasi sementara hendaklah disampaikan kepada pemberi pendidikan tinggi dan notis itu hendaklah menyatakan alasan bagi pembatalan itu. (3) Pemberi pendidikan tinggi hendaklah diberi peluang untuk membuat representasi bertulis dalam masa tiga puluh hari dari tarikh penerimaan notis dalam subseksyen (2). (4) Selepas tamat tempoh tiga puluh hari yang dinyatakan dalam subseksyen (3) dan selepas menimbangkan apa-apa representasi yang dibuat, Agensi hendaklahβ€” (a) mengeluarkan amaran dan memberikan arahan supaya pemberi pendidikan tinggi itu membetulkan keadaan sehingga Agensi berpuas hati, dalam masa yang ditentukan; atau (b) meneruskan dengan cadangan tindakan untuk membatalkan perakuan akreditasi sementara itu. (5) Jika pemberi pendidikan tinggi gagal untuk membetulkan keadaan sebagaimana yang dikehendaki di bawah perenggan (4)(a), Agensi boleh meneruskan untuk membatalkan perakuan akreditasi sementara. (6) Pembatalan perakuan akreditasi sementara tidaklah menghalang pemberi pendidikan tinggi daripada mengemukakan permohonan baru. (7) Jika perakuan akreditasi sementara dibatalkan di bawah seksyen ini, Agensi hendaklah memberikan notis kepada pihak berkuasa atau badan profesional yang berkenaan memberitahu tentang pembatalan itu termasuk apa-apa syor yang perlu.
