s 43 Obligation of secrecy
(1) Except for any of the purposes of this Act or for the purpose of any civil or criminal proceedings under any written law, no member of the Council, member of the Implementation and Coordination Committees, member of a committee or person invited to attend any meetings of the Council, the Implementation and Coordination Committees or any committee, or the Chief Executive or officer or servant of the Council shall disclose or provide or cause any person to disclose or provide, any information or document which has been obtained by him or to which he has access in the course of his duties and which is not published pursuant to this Act.
(2) Any person who contravenes subsection (1) commits an offence and shall, on conviction, be liable to a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding two years or to both.

Obligasi kerahsiaan
(1) Kecuali bagi mana-mana maksud Akta ini atau bagi maksud apa-apa prosiding sivil atau jenayah di bawah manamana undang-undang bertulis, tiada anggota Majlis, anggota Jawatankuasa Pelaksanaan dan Penyelarasan, anggota mana-mana jawatankuasa atau orang yang diundang untuk menghadiri manamana mesyuarat Majlis, Jawatankuasa Pelaksanaan dan Penyelarasan atau mana-mana jawatankuasa, atau Ketua Eksekutif atau pegawai atau pekhidmat Majlis boleh menzahirkan atau memberikan atau menyebabkan mana-mana orang untuk menzahirkan atau memberikan apa-apa maklumat atau dokumen yang telah diperolehnya atau yang terhadapnya dia mempunyai akses semasa melaksanakan kewajipannya dan yang tidak disiarkan menurut Akta ini.
(2) Mana-mana orang yang melanggar subseksyen (1) melakukan suatu kesalahan dan boleh, apabila disabitkan, dikenakan denda tidak melebihi lima puluh ribu ringgit atau pemenjaraan selama suatu tempoh tidak melebihi dua tahun atau kedua-duanya.
