s 14 Certificate of registration

(1) In considering an application for registration as a credit reporting agency, the Registrar shall be satisfied that— (a) the applicant has a minimum paid-up capital as prescribed in section 20; and (b) the chief executive and directors of the applicant have fulfilled the criteria as specified in the Third Schedule. (2) After having given due consideration to the application for registration and the conditions as referred to in subsection (1), the Registrar may register the applicant or refuse the application for registration. (3) The decision of the Registrar to register the applicant or refuse the application for registration shall be communicated to the applicant in a written notice issued by the Registrar as soon as practicable. (4) Where the Registrar refuses the application for registration in pursuance of subsection (2), he shall in the written notice issued under subsection (3) state— (a) that the application has been refused; and (b) the reasons for the refusal. (5) Where the Registrar is satisfied that an applicant may be registered under subsection (2), he shall, upon receipt of the prescribed registration fee, issue to the applicant a certificate of registration in such form as may be determined by him, and the certificate of registration may be subject to such conditions or restrictions as the Registrar may think fit to impose. (6) The certificate of registration shall be valid for a period not exceeding three years.

Perakuan pendaftaran

(1) Semasa menimbangkan suatu permohonan untuk pendaftaran sebagai suatu agensi pelaporan kredit, Pendaftar hendaklah berpuas hati bahawa— (a) pemohon mempunyai modal berbayar minimum sebagaimana yang ditetapkan dalam seksyen 20; dan (b) ketua eksekutif dan pengarah pemohon telah memenuhi kriteria yang dinyatakan dalam Jadual Ketiga. (2) Selepas pertimbangan yang sewajarnya telah diberikan kepada permohonan untuk pendaftaran dan syarat yang disebut dalam subseksyen (1), Pendaftar boleh mendaftarkan pemohon itu atau menolak permohonan untuk pendaftaran itu. (3) Keputusan Pendaftar untuk mendaftarkan pemohon atau menolak permohonan untuk pendaftaran itu hendaklah disampaikan kepada pemohon melalui suatu notis bertulis yang dikeluarkan oleh Pendaftar secepat yang dapat dilaksanakan. (4) Jika Pendaftar menolak permohonan untuk pendaftaran itu menurut subseksyen (2), dia hendaklah dalam notis bertulis yang dikeluarkan di bawah subseksyen (3) menghuraikan— (a) bahawa permohonan itu telah ditolak; dan (b) sebab-sebab bagi penolakan itu. (5) Jika Pendaftar berpuas hati bahawa seorang pemohon boleh didaftarkan di bawah subseksyen (2), dia hendaklah, apabila menerima fi pendaftaran yang ditetapkan, mengeluarkan suatu perakuan pendaftaran kepada pemohon dalam apa-apa bentuk yang ditentukan olehnya, dan perakuan pendaftaran itu boleh tertakluk pada apa-apa syarat atau sekatan yang difikirkan patut dikenakan oleh Pendaftar. (6) Perakuan pendaftaran itu adalah sah selama tempoh tidak melebihi tiga tahun.
