s 86 Approval of prescribed modification, change or extension of approved railway schemes and deposit of plans, information and other documents

(1) The Minister may, after having due regard to the recommendation of the Director General of Land Public Transport, reject or grant conditional approval in respect of an application made under section 85. (2) Where the Minister grants conditional approval in respect of the application under subsection (1), the applicant shall deposit in the office of the Director General of Land Public Transport for public inspection such documents as may be specified by the Director General of Land Public Transport. (3) The Director General of Land Public Transport shall provide its recommendations on the application under subsection (1) to the Minister and for this purpose subsections 84(4) and (5) shall apply mutatis mutandis. (4) The Minister may, after considering the plans and sections and book of reference and any other documents as specified by the Director General of Land Public Transport, and any objections thereto and having due regard to the recommendations of the Director General of Land Public Transport— (a) give final approval to or reject the application under subsection (1); or (b) where he considers that the plans and sections should be amended, direct the applicant to reconsider such plans and sections and report to the Director General of Land Public Transport within such period as the Director General of Land Public Transport may require. (5) In the case where paragraph (4)(b) applies, the Minister may, after considering the amendments made to the plans and sections and having due regard to the objections made thereto and the recommendations of the Director General of Land Public Transport, give final approval to or reject the application under subsection (1). (6) The plans and sections, if approved by the Minister, whether under paragraph (4)(a) or subsection (5), shall be deemed to be deposited plans referred to in this Act. (7) The Minister may, in approving any application under subsection (1), impose any requirement or condition as he considers appropriate, having due regard to the recommendations of the Director General of Land Public Transport. (8) The decision of the Minister to grant or not to grant the approval under this section shall be communicated to the applicant by the Director General of Land Public Transport by written notice as soon as practicable. (9) The written notice by the Director General of Land Public Transport under subsection (8) shall specify— (a) in the case where the approval is granted, the fact of such grant and the requirements or conditions imposed under subsection (7); and (b) in the case of a refusal to grant the approval, the fact of such refusal and the reasons for the refusal. (10) A person who contravenes any requirement or condition imposed under subsection (7) commits an offence and shall, on conviction, be liable to a fine not exceeding five hundred thousand ringgit or to imprisonment for a term not exceeding three years or to both.

Kelulusan bagi ubah suaian, perubahan atau peluasan yang ditetapkan bagi skim kereta api yang diluluskan dan mendeposit pelan, maklumat dan dokumen lain

(1) Menteri boleh, setelah mengambil kira dengan sewajarnya syor Suruhanjaya, menolak atau memberikan kelulusan bersyarat berkenaan dengan suatu permohonan yang dibuat di bawah seksyen 85. (2) Jika Menteri memberikan kelulusan bersyarat berkenaan dengan permohonan di bawah subseksyen (1), pemohon hendaklah mendepositkan di pejabat Suruhanjaya bagi pemeriksaan umum apa-apa dokumen yang dinyatakan oleh Suruhanjaya. (3) Suruhanjaya hendaklah memberikan syornya mengenai permohonan di bawah subseksyen (1) kepada Menteri dan bagi maksud ini subseksyen 84(4) dan (5) hendaklah terpakai mutatis mutandis. (4) Menteri boleh, selepas menimbangkan pelan dan keratan serta buku rujukan dan apa-apa dokumen lain yang dinyatakan oleh Suruhanjaya, dan apa-apa bantahan terhadapnya dan setelah mengambil kira syor Suruhanjaya — (a) memberikan kelulusan muktamad kepada atau menolak permohonan di bawah subseksyen (1); atau (b) jika difikirkannya bahawa pelan dan keratan itu patut dipinda, mengarahkan pemohon supaya menimbangkan semula pelan dan keratan itu dan melaporkan kepada Suruhanjaya dalam apa-apa tempoh yang dikehendaki oleh Suruhanjaya. (5) Dalam hal jika perenggan (4)(b) terpakai, Menteri boleh, selepas menimbangkan pindaan yang dibuat kepada pelan dan keratan itu dan dengan mengambil kira bantahan yang dibuat terhadapnya dan syor Suruhanjaya, memberikan kelulusan muktamad kepada atau menolak permohonan di bawah subseksyen (1). (6) Pelan dan keratan itu, jika diluluskan oleh Menteri, sama ada di bawah perenggan (4)(a) atau subseksyen (5), hendaklah disifatkan sebagai pelan yang didepositkan yang disebut dalam Akta ini. (7) Menteri boleh, apabila meluluskan mana-mana permohonan di bawah subseksyen (1), mengenakan apa-apa kehendak atau syarat yang difikirkannya patut, dengan mengambil kira syor Suruhanjaya. (8) Keputusan Menteri untuk memberikan kelulusan atau tidak memberikan kelulusan di bawah seksyen ini hendaklah disampaikan kepada pemohon oleh Suruhanjaya melalui notis bertulis dengan secepat yang dapat dilaksanakan. (9) Notis bertulis oleh Suruhanjaya di bawah subseksyen (8) hendaklah menyatakan — (a) dalam hal apabila kelulusan diberikan, hakikat pemberian kelulusan itu dan kehendak atau syarat yang dikenakan di bawah subseksyen (7); dan (b) dalam hal keengganan untuk memberikan kelulusan, hakikat keengganan itu dan sebab-sebab bagi keengganan itu. (10) Seseorang yang melanggar apa-apa kehendak atau syarat yang dikenakan di bawah subseksyen (7) melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi lima ratus ribu ringgit atau dipenjarakan selama tempoh tidak melebihi tiga tahun atau kedua-duanya.
