s 41 Revocation of approval granted under subsection 40(1)

(1) The Bank may revoke an approval granted under subsection 40(1) to a licensee who carries on remittance business. (2) Where the Bank proposes to revoke the approval granted under subsection 40(1), the Bank shall give the licensee a written notice setting out the proposed revocation and the grounds for the revocation. (3) The licensee shall be given an opportunity to make written representation to the Bank within fourteen days from the date of the written notice. (4) Where no written representation is received by the Bank within the period specified under subsection (3), the Bank shall revoke the approval by written notice. (5) Where written representation is received, the Bank, after considering the representation, shall give the licensee written notice of its decision. (6) A revocation under subsection (4), or a decision to revoke an approval under subsection (5), shall not take effect until the expiration of fourteen days from the date of the written notice under subsection (4) or (5) or such other period as the Bank may specify, as the case may be. (7) Where the Bank decides under subsection (5) not to revoke the approval, it may impose such conditions on the licensee as it may specify in the written notice given under that subsection. (8) A licensee who fails to comply with any condition imposed under subsection (7) commits an offence.

Pembatalan kelulusan yang diberikan di bawah subseksyen 40(1)

(1) Bank boleh membatalkan sesuatu kelulusan yang diberikan di bawah subseksyen 40(1) kepada seseorang pemegang lesen yang menjalankan perniagaan pengiriman wang. (2) Jika Bank bercadang untuk membatalkan kelulusan yang diberikan di bawah subseksyen 40(1), Bank hendaklah memberi pemegang lesen itu suatu notis bertulis yang menyatakan pembatalan yang dicadangkan itu dan alasan pembatalan itu. (3) Pemegang lesen itu hendaklah diberi peluang untuk membuat representasi bertulis kepada Bank dalam tempoh empat belas hari dari tarikh notis bertulis itu. (4) Jika tiada representasi bertulis diterima oleh Bank dalam tempoh yang ditentukan di bawah subseksyen (3), Bank hendaklah membatalkan kelulusan itu melalui notis bertulis. (5) Jika representasi bertulis diterima, Bank, setelah mempertimbangkan representasi itu, hendaklah memberi pemegang lesen itu suatu notis bertulis tentang keputusannya. (6) Suatu pembatalan di bawah subseksyen (4), atau suatu keputusan untuk membatalkan suatu kelulusan di bawah subseksyen (5), tidak boleh berkuat kuasa sehingga habis tempoh empat belas hari dari tarikh notis bertulis di bawah subseksyen (4) atau (5) atau apa-apa tempoh lain sebagaimana yang ditentukan oleh Bank, mengikut mana-mana yang berkenaan. (7) Jika Bank membuat keputusan di bawah subseksyen (5) untuk tidak membatalkan kelulusan itu, ia boleh mengenakan apa-apa syarat ke atas pemegang lesen itu sebagaimana yang ditentukannya dalam notis bertulis yang diberikan di bawah subseksyen itu. (8) Seseorang pemegang lesen yang tidak mematuhi apa-apa syarat yang dikenakan di bawah subseksyen (7) melakukan suatu kesalahan.
